<br />..s. ð(!-£:., <br /> <br />In addition, the City Attorney's office has advised staff that under current policy, the City <br />Manager does not have signature authority to enter into the following agreements, which <br />staff is also recommending: ' <br /> <br />Agreements Where the City Is Providing a Service - Periodically, the City has the <br />opportunity to provide services (i.e. sell our services to other agencies), such as Human <br />Resources training or Information Technology support, to other parties. Given our recent <br />financial situation, City staff has been more aggressive in pursuing outside contracts to <br />generate revenue as a way to meet our budget reductions and avoid layoffs where <br />possible. Time is often of the essence in obtaining these agreements. In situations where <br />the total annual revenues the City will generate by way of such agreements do not exceed <br />$125,000 per year, it is recommended that the City Manager be authorized to enter into <br />these agreements. Please see Attachment I for examples of such agreements. <br /> <br />This policy also provides that in situations where the revenue expected to be received by <br />the City for providing a service is less than $10,000 per year, department heads of the <br />department providing the service may execute such agreements. <br /> <br />Fiscal Agent Agreements - The City acts as the fiscal agent upon approval by Council for <br />Redwood City 2020, and administers grants and service agreements on behalf of <br />Redwood City 2020 (RC 2020). Policy decisions as well as administrative decisions <br />regarding revenues and expenditures are made by RC 2020's Governing Board and <br />Operations Committee, and not by the City Council. The City is simply serving as a fiscal <br />agent for RC 2020 as a way of being collaborative and more efficient. Therefore, it is <br />recommended that the City Manager be authorized to enter into fiscal agent agreements <br />whenever the revenue to be received does not exceed $300,000 or the expenditures do <br />not exceed $100,000 upon the direction of the RC 2020 Governing Board or Operations <br />Committee. <br /> <br />The City Attorney has recommended that should the Council be in agreement with these <br />recommendations, the authority be providèd by way of a Council-adopted administrative <br />policy (attached for your review). <br /> <br />In spite of the authority granted to the City Manager on November 2002 and under this <br />proposed policy should Council elect to adopt, the City Manager will seek Council approval <br />and authority to enter into agreements, memberships, etc. that involve a policy decision as <br />to whether or not the City should participate in such activity regardless of the dollar <br />amount. <br /> <br />Alternative <br />The Council may elect not to extend the authority for the above transactions to the City <br />Manager. Doing so will require staff resources to bring these items to Council for approval <br />and may, particularly in the case of revenue generating opportunities, result in the City not <br />being able to take advantage of suchJ>pportunities if there is a brief time period in which <br />the City needs to respond to the prospective client. <br /> <br />2 <br />
