6.1.1. - Page 2 <br />1) "Review and revise, if needed, the current fee structure to recoup staff costs <br />for processing cell tower applications ". Redwood City's fees for processing <br />cellular communications facilities are predominately cost recovery based and meet <br />the above recommendation. <br />2) "Negotiate lease agreements for future installations on public land that <br />generate revenue or other tangible benefit to the community ". Redwood City <br />currently negotiates lease agreements in compliance with the above <br />recommendation. <br />3) "Add cell tower maintenance and removal provisions if they are not already <br />included in existing ordinance and lease agreements." Redwood City's Wireless <br />Communications permit regulations are contained in Sections 38.6 and 38.7 of the <br />Redwood City Zoning Ordinance. These regulations were adopted in March 26, <br />1997 (Ordinance 1130.297) and conform to the most current regulations on the topic <br />of wireless antennae, including the Telecommunications Act of 1996. Both the <br />Zoning Ordinance and the lease agreements contain maintenance and removal <br />provisions as prescribed in the above recommendation. <br />4) "Require that all new lease agreements containing a provision requiring <br />service providers to install newer technology as it becomes commercially <br />available to reduce the footprint of cell towers ". Redwood City agrees to include <br />a similar provision in its standard cell tower lease agreement and at the same time <br />recognizes that most companies will agree to do this over time as they replace <br />towers and /or related equipment, but not necessarily to replace the components of <br />the installations as soon as new technology becomes available. <br />5) "Develop a webpage within County and City websites which clearly post local <br />ordinances, policies and procedures as well as federal regulations related to <br />cell tower installations." To facilitate public understanding of the above, a <br />"Wireless Communication Permit" handout is available at the City's application <br />counter and this document is also on the City's website along with the necessary <br />permit application information. (Attachment 3) <br />ALTERNATIVES <br />Disagree wholly or partially with the Grand Jury finding, in which case the response <br />shall specify the portion of the finding that is disputed, and shall include an explanation <br />of the reasons therefore. <br />FISCAL IMPACT <br />None, Redwood City's permit fee structure and lease agreements are in compliance <br />with the Grand Jury recommendation. <br />
