Att6.3.B. - Page 23 <br />indemnifying lessor against liability for the same and holding Leased Premises free from the effect of <br />such lien or claim. <br />(c) Before construction of any Improvements is commenced on the <br />Leased Premises and before any building materials therefor have been delivered to the Leased Premises by <br />Lessee or agents under Lessee's authority, Lessee shall comply with the following conditions or procure <br />LeLWs written waiver of the condition or con ditions specified in the waiver. <br />(1) Visual and Environmental Imnact Lessee shall use its best <br />efforts to make any Improvements on the Leased Premises aesthetically pleasing and environmentally <br />neutral. Notwithstanding the foregoing, Lessor reserves the right to require that reasonable measures be <br />undertaken to improve the visual or environmental impact of any proposed improvement or alterations of <br />the Leased Premises. <br />(2) Construction Schedule. Lessee shall deliver to the Lessor <br />for the Lessor's approval a time schedule setting forth in detail a description of the Improvements and all <br />steps for construction of the Improvements, and Lessee's best estimate of the date upon which each step <br />shall be substantially completed. The Lessor's approval, which shall not be unreasonably withheld, or <br />disapproval of the schedule shall be communicated to Lessee in the manner provided for the giving of <br />notice herein and any disapproval shall be accompanied by a specification of the grounds for disapproval. <br />mm pm.mm m. m -m =-, ill � yq 1 �1P 1 \ . in 1 ;!� <br />Lessee shall protect Lessor's property against damage resulting from the performance of any work <br />undertaken by Lessee or Lessee's agents, employees, contractors, or assigns, and shall indemnify the <br />Lessor against all liens or liability in any way arising out of the performance of the work or the furnishing <br />of labor, services, materials, supplies, egdipment or power in connection therewith, except to the extent <br />caused by the negligence or willful misconduct of Lessor. <br />(4) jULWep& In addition to the insurance coverage otherwise <br />required under this Lease, Lessee shall maintain or cause to be maintained Workers' Compensation <br />Insurance covering all persons employed in connection, with the contraction of any Improvements, repair <br />or maintenance activities with respect to whom death or injury claims could be asserted against the Lessor, <br />Lessee, or the Leased Premises. Lessor may require that any third patties performing work on the Leased <br />Premises maintain such Workers' Compensation Insurance as well. Such insurance shall be maintained as <br />Lessee's sole cost and expense at all times when any work is in process and shall otherwise conform to the <br />requirements of this Leese for insurance. <br />(S) Notice of C=plefion Immediately on substantial completion <br />of any improvement, Lessee shall prepare and provide Lessor with a notice of completion suitable for <br />recordation in the official records of the County of San Mateo. Lessor, at its option, may elect to record <br />said notice. <br />Q <br />
