'r ,\ � <br /> AGREEMENT OR�GINAL <br /> COST SHARING AGREEMENT FOR THE ADJUSTMENT OF SANITARY <br /> SEWER MANHOLES IN CONJUNCTION WITH THE CITY'S 2010-2011 <br /> STREET OVERLAY PROJECT. <br /> THIS AGREEMENT made and entered into this � day of , 2011, <br /> by and between the FAIR OAKS SEWER MAINTENANCE DISTRICT, h rei fter called "DistricY', <br /> and the CITY OF REDWOOD CITY, Municipal Corporation of the State of California, hereinafter <br /> referred to as "CITY". <br /> WITNESSETH: <br /> WHEREAS, the City wishes to resurface East Bayshore Road within City limits, as <br /> shown on Exhibit "A" attached hereto; and <br /> WHEREAS, it is estimated that five (5) District-owned sanitary sewer manhole covers <br /> located within the City's Right of Way on East Bayshore Road will require adjustment to the new <br /> grade of the improved road and District has requested the City to include this work in the City's <br /> project ("the ProjecY'); and <br /> WHEREAS, City and District agree that the City shall act as lead agency with respect to <br /> the Project in the preparation of plans, specifications, construction administration, construction <br /> inspection, and related documents for the resurfacing of East Bayshore Road, except that <br /> District shall provide special provisions and standard detail for the adjustment of the sanitary <br /> sewer manhole covers to be included in the contract documents. <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> 1. District requests and grants City permission to perform work on designated <br /> manhole covers; <br /> 2. The City will award a contract for the Project to the lowest responsible bidder <br /> ("Project Contracto�") pursuant to the City's competitive bid processes as set forth in Chapter 2, <br /> Section VII of the Redwood City Municipal Code.
