successful bidder to whom the construction contract is awarded. <br /> 3. The work to be performed shall be completed pursuant to and in accorii with <br /> project contract document that includes; special provisions and manhole cover adjustment <br /> standard detail as provided by District. The construction contract shall require the contractor to <br /> obtain and maintain insurance and surety bonds as set forth in the City's standard public works <br /> contract Document 700 General Conditions, Part II. The contractor shall be required to comply <br /> with all applicable laws as set forth in the City's standard public works contract Document 700 <br /> General Conditions, Part Vl. <br /> 4. District agrees to reimburse City the total cost incurred by the City for work on <br /> District facilities, as follows: <br /> a. District shall pay City for its actual costs for its portion of the work, in the <br /> amount currently estimated to be one thousand three hundred and seventy-five dollars ($1,375); <br /> b. District shall pay City ten percent (10%) of the actual costs of its portion of <br /> the work for project management; <br /> c. District shall pay for any change orders related to its portion of the work, <br /> provided District approves said change order(s) in writing <br /> d. District shall pay City pursuant to the terms of this Agreement within 30 <br /> days of City invoice to District. <br /> 5. City shall be solely responsible for managing the Project Contractor. All District <br /> communications regarding the Project shall be directed to the City's appointed representative. <br /> However, District shall have access to inspect District facilities at all time and shall inspect <br /> District facilities prior to Project completion. <br /> 6. District acknowledges and agrees that upon completion, elimination, or <br /> abandonment of work specified under this Agreement, District shall maintain the designated <br /> manholes and that other than the improvements being made as a part of this project to the <br /> manholes; City has no other obligation or responsibility for the manholes. <br /> 7.
