(4) San Carlos Fire Department employees are not, and shall not be <br /> deemed, Redwood City employees for any purpose. San Carlos shall be solely responsible for all <br /> salary, benefits, workers' compensation, and insurance for its personnel providing Cross <br /> Firefighter Services pursuant to this Amendment. Said personnel shall be considered solely <br /> employees of the City of San Carlos for all supervisory, disciplinary, and other employment <br /> related purposes. <br /> (e) Cross Services Termination Date. The Participating Agencies are currently <br /> exploring the possibility of Redwood City providing San Carlos with expanded fire and <br /> emergency services. The Cross Firefighter Services are intended to be provided as an interim <br /> solution for the Participating Agencies while they continue to explore the expanded fire and <br /> emergency services. As such, both Participating Agencies' obligations to provide Cross <br /> Firefighter Services shall expire on January 31, 2013 ("Cross Services Termination Date"), unless <br /> the City Manager of each Participating Agency agrees in writing to extend the Cross Services <br /> Termination Date to a later date certain. <br /> 4. Indemnification. No Participating Agency shall be responsible for the acts or <br /> omissions of the other Participating Agency's officers or employees, nor shall any Participating <br /> Agency incur any liability arising out of the services of any other Participating Agency's officers <br /> or employees. Accordingly, the Participating Agencies hereby expressly agree to waive the pro <br /> rata risk allocation contained in Government Code section 895.6. <br /> 5. Ratification. The Participating Agencies acknowledge and agree that the <br /> Agreement, except as amended by this Second Amendment, remains unmodified and in full force <br /> and effect in accordance with its terms. <br /> 6. Interpretation. As used in this Second Amendment, masculine, feminine or neutral <br /> gender and the singular or plural number shall each be deemed to include the others where and <br /> when the context so dictates. The word "including" shall be constructed as if followed by the <br /> words "without limitation."
