9.A.10 <br />Legislative Bill Action <br />................................ ............................... <br />AB 1426 (Steinberg). Sacramento Region. <br />Affordable Housing Standard. This bill requires <br />at least 10 percent of new building permits within <br />the Sacramento region to be built for low and very <br />low- income households. While the goal of the bill <br />is laudable, the reality is no funding is identified. <br />Affected local governments have estimated the <br />total subsidy cost to the region at over $500 <br />million over a five -year period, and higher when <br />factoring in recent state - imposed prevailing wage <br />requirements. AB1426 moved off the Senate <br />Appropriations Suspense File to the Senate floor <br />on Tuesday. Concerned cities should send letters <br />of opposition to the author, the governor and their <br />legislators. Staff: Dan Carrigg, Status: SenFlr, <br />Position: Oppose. <br />for the year. Assembly Members John Dutra, Joe <br />L anciamilla, and Ron Calderon were extremely <br />hei:)ful in this endeavor. <br />After receiving policy guidance from a League <br />subcommittee on CEQA, League staff worked with <br />a broad coalition of groups to draft an alternative <br />proposal that was more reasonable, respected <br />local ordinances, and retained local authority. <br />Ultimately, this alternative proposal was rejected <br />by the sponsors. During the interim, cities are <br />advised to continue tracking this bill, since there is <br />a strong possibility that it will become active again <br />next session judging by recent grassroots advo- <br />cacy pieces released from various environmental <br />groups. Staff: Dan Carrigg, Status: AsApps— <br />Suspense File, Position: Oppose. <br />SB 18 (Burton). Traditional Tribal Cultural <br />Sites. SB 18 requires all lead agencies to send <br />their environmental documents to the Native <br />American Heritage Commission for lengthy <br />reviews, for potential impacts on vaguely- defined <br />"Traditional Tribal Cultural Sites." The bill also <br />limits lead agency ability to make the finding of <br />"overriding considerations." As amended, SB 18 <br />is a flawed and unbalanced proposal, with vague <br />language, which inappropriately removes local <br />authority, and will lead to many unnecessary <br />delays to housing and other development projects. <br />The bill was approved by the Assembly Appropria- <br />tions Committee on Friday, and now moves to the <br />Assembly Floor. Cities are encouraged to send <br />opposition letters to the author, their legislators <br />and the Governor. A copy of the League's letter <br />outlining the major issues with the bill as well as a <br />sample letter for cities is available at the League's <br />Web site. Following <br />intense lobbying by the League and a coalition of <br />local government, business and development <br />groups, SB 711 which would have imposed <br />excessive mitigation requirements on any devel- <br />opment on land containing oak trees, remained on <br />the Assembly Appropriations Suspense File. This <br />development has stopped action on this measure <br />ENVIRONMENTAL <br />SB 20 (Sher). E- Waste. SB 20 was <br />amended last week to reflect in part, the input of a <br />variety of interest groups —most specifically the <br />computer and television industry. It has been <br />simplified and now would impose one up -front <br />collection and recycling fee that would be collected <br />at the retail level to fund E -waste collection and <br />recycling programs. This is in lieu of the two types <br />of fees that were included in the previous version <br />of the bill. In this form, the bill looks more like last <br />year's SB 1523 in how the fee is calculated and <br />imposed. However, SB 20 includes significant <br />additional manufacturer responsibility require- <br />ments. More amendments are anticipated be- <br />tween now and the end of the session next week. <br />Staff: Yvonne Hunter, Status: ASmFIr, Position: <br />Support. <br />PUBLIC SAFETY <br />AB 49 (Simitian). Crime. Existing law <br />establishes the High Technology Theft Apprehen- <br />sion and Prosecution Program Trust Fund, and <br />specifies the purposes for which the moneys in <br />the fund may be used.
