9,A-11
Legislative Bill Action
................................ ...............................
mittee, composed of members representing
various govemmeotal agencies and profes-
sior•al organizations, to create a written strategy
for addressing high technology crime and advising
on the appropriate disbursement of funds from the
High Technology Theft Apprehension and Pros-
ecution Program Trust Fund to regional task
forces. AB 49 creates the California High Technol-
ogy Crimes Task Force, which would be com-
prised of each regional task force funded by the
High Technology Theft Apprehension and Pros-
ecution Program. Staff: Natasha Fooman,
Status: SenFlr, Position: Support.
AB 319 (Frommer). Firearms. Existing law
prohibits a juvenile convicted of specked offenses
from possessing a firearm until age 30. AB 319
would add possession of a concealed or loaded
gun, and allowing a loaded gun to be brought into
a vehicle, to the list of serious offenses for which
conviction results. Violation is punishable by up to
one year in the county jail, or by 16 months, two,
or three years in state prison, and /or by a fine of
up to $1,000. According to the author, "These
juveniles pose a threat to public safety. This bill will
take these weapons out of their hands." Staff:
Natasha Fooman, Status: SenFlr, Position:
Support.
AB 936 (Reyes). Trespass. Maternity
Wards. AB 936 defines a new form of trespass
committed where a person enters or remains in a
maternity ward or birthing center under circum-
stances that indicate the trespasser has no lawful
business in the premises. AB 936 provides that
trespassing in a maternity ward or birthing facility
is subject to the following penalties: A first convic-
tion, where a person leaves upon request, results
in an infraction - punishable by a fine up to $100. A
first conviction where a person refuses to leave
after being requested to do so by peace officer or
authorized personnel results in a misdemeanor -
punishable by a imprisonment of up to one year in
county jail, a fine of up to $1,000, or both. A
second or subsequent conviction results in a
misdemeanor, punishable by imprisonment in
county jail for up to one year, a fine of up to
$2,000, or both. AB 936 also provides that the
court shall order counseling as a condition of
probation, and order the defendant to pay for the
counseling, unless the court finds good cause to
not make such orders. Staff: Natasha Fooman,
Status: Governor's Desk, Position: Request for
Signature.
AB 1044 (Negrete McLeod). Licenses to
Carry Firearms. AB 1044 makes specified
changes in the statutes pertaining to licenses to
carry concealable weapons (CCWs) in California.
AB 1044 removes the Department of Justice's
(DOJ) obligation to file and store all copies of
CCW permits and, instead, requires DOJ to
maintain a list of all CCWs. The DOJ has no
supervisory authority or oversight over sheriffs and
police chiefs regarding the issuance of these
permits, therefore making them unnecessary.
The obligation to file and store copies of CCW
permits results in significant burdens and ex-
penses with no benefits to DOJ. AB 1044 pro-
vides that DOJ will no longer be required to main-
tain hard copy printouts of firearm- related informa-
tion in its databases. Commonly, digital formatting
is the preferred and most efficient means to
provide such information, with less cost. AB 1044
also relieves DOJ of the obligation to adopt and
implement the Standard CCW application form
and provides that DOJ review and, as necessary,
revise the standard CCW application. This bill
exempts the CCW applications form from the
requirements of the Administrative Procedures Act
by stating that the standard form is deemed to be
a local form and thus exempt from that Act. Staff:
Natasha Fooman, Status: Governor's Desk,
Position: Request for Signature.
For legislators' phone numbers, ad-
dresses and e-mail please see the
League's website (www.cacities.ora/
advocacvicenter).
Visit the League's Official Web Site -- www.cacities.org PRIORITY FOCUS /PAGE 11
