not made, the City shall make repairs with the cost being billed to BFC. <br /> <br /> (b) If Public Right-of-Way to be used by BFC has preexisting installation(s), <br />BFC shall assume the responsibility to verify the location of the preexisting <br />installation and notify City and any third party of BFC's proposed installation. The <br />cost of any work required of such third party or City to provide adequate space or <br />required clearance to accommodate BFC's installation shall be borne solely by <br />BFC. <br /> <br /> 12. Joint Participation With Other Utilities. <br /> <br /> (a) To ihe extent it is practicable to do so, BFC shall cooperate with all <br />other permittees, utilities, and permit applicants in the planning, location, and <br />construction of their joint and several telecommunications facilities within the <br />Public Right-of-Way. BFC shall, within thirty (30) days of receipt of the demand of <br />the City Engineer, deliver to the City Engineer such maps, plans, and diagrams as <br />may be required to show, in detail, the exact location, size, depth, and description <br />of the Facilities within the Public Right-of-Way in relation to all other permittee <br />telecommunication facilities. Upon request of the City, BFC shall pothole its <br />subsurface Facilities, at its sole cost and expense, with respect to any existing <br />City or third party underground utilities, telecommunication, er other facilities. <br /> <br /> (b) In accordance with the provisions of Chapter 3.1 of Division 5 of Title 1 <br />of the Government Code of the State of California (§ 4216, et seq.), BFC, as an <br />operator of a subsurface installation, shall obtain and maintain membership in a <br /> <br />Agmt-0$2 <br />o~/oc, m~ 18 <br /> <br /> <br />
