k. Expend all funds under this agreement in accordance with all applicable <br /> provisions of law. <br /> <br /> 1. To the extent not otherwise prohibited by law, and to the extent required <br /> by the California Public Records Act, to place in the public domain any software, written <br /> document, or other product developed with funds received through this Agreement. <br /> m. Any recipient of TFCA funds used to purchase any vehicle(s) must either <br /> obtain approval for alternate use of the vehicle(s) or return to C/CAG any funds realized <br /> from the sale of any vehicle(s) purchasedwith TFCA funds if such reuse or sale occurs <br /> within the industry standards for the useful life from the date of purchase of the vehicle(s). <br /> The amount of funds returned to the Program Manager shall be proportional to the <br /> percentage of TFCA funds originally used to purchase the vehicle(s). <br /> 2. C/CAG shall provide funding to the CITYin the amount of $250,000. Funds shall <br />be provided to the CITYon a cost reimbursement basis. Quarterly invoices, with supporting <br />documentation proving the legitimate expenditures for the intended purpose of the approved <br />project, should be provided to C/CAG for payment. Costs will be reimbursed only to the amount <br />of the AB 434 funds authorized. In no event shall C/CAG be required to provide any funding to <br />the CITY under this Agreement unless such funds are first provided to C/CAG by BAAQMD. <br /> <br /> 3. The CITY shall be responsible for the proper expenditure of any funds provided <br /> under this Agreement. In the event that, for any reason, BAAQMD seeks return of funds granted <br /> tO the CITY, the CITY shall indemnify C/CAG in the amount C/CAG is required to return to <br /> BAAQMD under the Funding Ag~ement dated August 1997. <br /> <br /> 4.
