agreements and protocols available to the City, to ensure that said simultaneous <br /> needs are met equally. <br /> <br /> 4. Fees. The City has authority to charge all applicable fees in the Fire Protection <br /> <br />Sub-Zone for fire prevention related services such as plan checking, new construction inspection, <br />building and occupancy inspections, fire permits and emergency planning at the same rates as <br />those charged within the City for the same services. Such fees shall be charged to and paid by <br />those receiving such fire prevention related services and shall not be billed to the County in the <br />manner provided in Paragraph 5, "Compensation". <br /> <br /> 5. Compensation. The County agrees to compensate the City for providing fire <br /> <br />protection services in Fire Protection Sub-Zone in the following manner: <br /> <br /> (a) For each quarter of Fiscal Year 1997/98, the County shall pay the City the Base <br /> Fee for each Chargeable Call that quarter. The County shall also pay the City the <br /> Base Fee for each Code 3 Non-Chargeable Call that quarter which is a Non- <br /> Chargeable Call solely because the Response Time exceeded three (3) minutes and <br /> thirty (30) seconds, up to a maximum number of such Code 3 Non-Chargeable <br /> Calls equal to ten percent (10%) of the total of the Code 3 Chargeable Calls that <br /> quarter of the Fiscal Year plus the Code 3 Non-Chargeable Calls that quarter of <br /> the Fiscal Year which are Non-Chargeable Calls solely because the Response Time <br /> exceeded three (3) minutes and thirty (30) seconds. For example, during one <br /> quarter of a Fiscal Year there are two (2) Code 2 Chargeable Calls; one (1) Code 2 <br /> Non-Chargeable Call; forty-five (45) Code 3 Chargeable Calls; eight (8) Code 3 <br /> Non-Chargeable Calls which are Non-Chargeable Calls solely because the <br /> Response Time exceeded three (3) minutes and thirty (30) seconds; and two (2) <br /> Code 3 Non-Chargeable Calls which are Non-Chargeable Calls for reasons other <br /> than Response Time alone. In this example the total of the Code 3 Chargeable <br /> Calls and the Code 3 Non-Chargeable Calls which are Non-Chargeable Calls solely <br /> because the Response Time exceeded three (3) minutes and thirty (30) seconds is <br /> 53 calls (45+8), and ten percent (10%) of this total is five (5) calls. Therefore, in <br /> this example the County would pay the City the Base Fee or adjusted Base Fee, as <br /> <br /> 5 10/21/97 <br /> <br /> <br />
