In the event of concurrent negligence of the County, its officers and/or employees and the <br />City, its officers and/or employees, the liability for any and all claims or actions for injuries or <br />damages to persons and/or property which arise under this Agreement shall be apportioned under <br />the California theory of comparative negligence as presently established, or as may be hereafter <br />modified. <br /> <br /> 10. Severabilit~. <br /> <br /> If any provision of this Agreement is for any reason deemed to be invalid, and <br />unenforceable, the invalidity or unenforceability of such provision shall not affect any of the <br />remaining provisions of this Agreement. <br /> <br /> 11. Entire Agreement. <br /> <br /> This Agreement, including the Exhibit, represents the full and entire Agreement between <br />the parties with respect to the matters covered herein and supersedes all prior agreements. <br /> <br /> 8 10/21/97 <br /> <br /> <br />
