2. Paragraph 2 of the Agreement is amended to read as follows: <br /> <br /> "2. Compensation; Expenses; Payment. City shall <br /> compensate Architect for all services performed (Phases V through <br /> VII) by Architect hereunder in an amount based upon Architect's <br /> hourly rates that are currently prevailing. A copy of Architect's <br /> hourly rates for which services hereunder shall be performed are <br /> set forth in Architect's Fee Schedule marked Exhibit 'B,' attached to <br /> the Agreement and incorporated therein. <br /> <br /> Notwithstanding the foregoing, the combined total of <br /> compensation and reimbursement of costs payable hereunder for <br /> Phases V through VII shall not exceed the sum of Two Hundred <br /> Forty-six Thousand Two Hundred Eighty-Four Dollars ($246,284) <br /> unless the performance of services and/or reimbursement of costs <br /> and expenses in excess of said amounts have been approved in <br /> advance of performing such services or incurring such costs and <br /> expenses by City's City Council, evidenced by motion duly made <br /> and carried. <br /> <br /> Compensation and reimbursement of costs and expenses <br /> hereunder shall be payable upon monthly billing therefor by <br /> Architect to City, which billing will include bills from consultants <br /> retained by Architect and costs incurred, respectively, for items <br /> billed, the total amount authorized by the Agreement, additional <br /> <br />Agmt-053 2 <br />G :~shared~Redwooo~Cou ncil <br />FXS:rg <br />12/23/96 <br />01/08/97 <br /> <br /> <br />
