JPR Fax:65057574a8 Jun 17 '99 ]8:~8 P. 06 <br /> <br /> ORIGINAL <br /> <br /> Resolution No. 99-03 <br /> <br /> A Resolution of the Board of Directors of the <br /> San Marco Pre-Hospital Emergency Medical Services providers Group <br /> Approving an Amendment to the Joint Powers Agreement <br /> Establishing the Group Relating to Insurance <br /> <br /> WI-IER,EA$, Section XIII (Liability) of the Joint Powers Agreemen! {:_s-~ablishUmg <br /> the San Marco Pre-Hospital Em~gency Services Providers Group ("Group") authorizes <br /> the Group to maintain such public liability and other insuranc~ as deemed appropriate; <br /> and <br /> WH~RE..AS, the slrucrule of the public liability and other insurance to be <br /> mainlamed by the Group requires an amendment to Section XIII (Liability) of the Joint <br /> Powers Agreement; and <br /> WREREAS, th~ arnendraent to Section XII! (Liability) allows the Board of <br /> Directors to adopt provisions obligating the Parties to defend and/or indemnify uh¢ Group <br /> for defined claims and liabilities to the ext~nt required as a con&tion to procuring and/or <br /> maintaining the public Uabili~y and other insurance described in Section XIII; ~ud <br /> WHEREAS, Section X'V of the Joint Powers Ag.,,eement provides that it may be <br /> amended by an affirmative vo~ of two-thirds of the governing bodies of all Parties; and <br /> WIiEREAS, the Board of Directors of thc Group has reviewed the amendment to <br /> Section Xlll(Liability) attached to this Resolution No. 99-c~ as Exhibit A. <br /> NOW, THEREFORE, the Board of Directors of the San Mateo Pre-Hospital Emergency <br /> Services Provider~ Group does hereby resolve a,s follows: <br /> sECTION 1. The amendment to 5ccUon XII1 (Liability) ot'th¢ loire Powers Agreement <br /> Establishing the San Marco Pre-Hospital Emergency Services Providers Group attached <br /> as Exhibit A to this resolution is hereby approved. <br /> sECTION 2.
