C. Sewer Service <br /> <br /> The DEVELOPER shall disconnect current sewer service from the REDWOOD CITY <br /> sewer system. The DEVELOPER shall extend the existing SAN CARLOS sewer trunk <br /> line south to service the property. This shall be done at no cost to REDWOOD CITY. <br /> <br /> D. Water Service <br /> <br /> The CITY OF SAN CARLOS, at its option, may seek amendment of the water service <br /> boundaries in order that the California Water Service Company may provide water <br /> service to the PROPERTY. At such time as the boundaries are modified and facilities <br /> are installed, the PROPERTY shall connect to the California Water Service Company <br /> system and disconnect from the REDWOOD CITY water facility. REDWOOD CITY will <br /> cooperate with such an amendment but will not be obligated to incur any expense <br /> related to this amendment. <br /> <br /> E. Traffic Signal <br /> <br /> The cities agree that the traffic issues that have been raised have been resolved. The <br /> light will be installed at the beginning of the project. The developer will pay for the light <br /> and future maintenance costs. <br /> <br /> F. Landscaping <br /> <br /> The cities agree that there will be sufficient landscaping along Industrial Way so as to <br /> provide a visual buffer to the residents of the Centennial Neighborhood. <br /> <br /> G. Neighborhood Enhancement <br /> <br /> DEVELOPER is to grant REDWOOD CITY $5,000 with the funds to be used, as <br /> REDWOOD CITY chooses, to deal with issues in the Centennial Neighborhood that are <br /> exacerbated by this project. <br /> <br />V. Non-Assignment <br /> This Agreement is not assignable either in whole or in part. <br />VI. Amendments <br /> This Agreement may be amended or modified only by written agreement signed by both parties. <br />VII. Validity <br /> <br /> The invalidity, in whole or in part, of any provision of this Agreement shall not void or affect the <br /> validity of any other provision of this Agreement. <br /> <br /> VIII. Goveming Law <br /> <br /> The laws of the State of California shall govern this Agreement, and any suit or action initiated <br /> by either party shall be brought in the County of San Mateo, Califomia. <br /> <br /> IX. Mediation <br /> <br /> Should any dispute arise out of this Agreement, the parties shall meet in mediation and attempt <br /> to reach a resolution with the assistance of a mutually acceptable mediator. The costs of the <br /> mediator, if any, shall be paid equally by the parties. If a mediated settlement is reached, neither <br /> <br /> Page 3 <br /> <br /> <br />
