City acknowledges that the System relies upon novel technology and <br />techniques which are new to law enforcement. Also, there are inherent <br />limitations in the System and in existing technology which are not subject to <br />guarantee. Accordingly, while Supplier guarantees that physical components of <br />the System will not be defective, Supplier does not warrant or guarantee total <br />system performance in all circumstances. The System's dependence on <br />acoustical propagation necessarily implies that not all regions of the Subject <br />Area will be covered, that two nearly simultaneous impulsive events may <br />preclude valid results, and that the determination of gunfire locations will <br />occasionally be erroneous. City further acknowledges the present system may <br />be unable to distinguish gunshot sounds from similar explosive events such as <br />fireworks or automobile backfires, and that shots inside buildings or in narrow <br />confines between buildings may not be detectable. <br /> <br /> 16. Insurance. The Supplier shall provide comprehensive general <br /> liability insurance covering bodily injury and property damage, in an amount of <br /> not less than a combined single limit of $1,000,000 for one or more persons <br /> injured in each occurrence or property damage by a single occurrence.
