231 <br /> Portola Valley, Woodside, Atherton, Hillsborouqh and Brisbane and <br /> the count�es of Mar�n and Santa Cruz have banned all fireworks this <br /> year because of the conditions caused by the drought Chief Kelier <br /> advised also that the State Division of Forestry has declared <br /> hazardous areas which border the City limits He suggested that <br /> � after 201 years, perhaps the citizens of the United States mi9ht <br /> , have become sufficiently mature to celebrate Independence Day with- <br /> out taking the risk of burning homes and maiming people while doing <br /> so Chief Keller observed that since the State appears to refuse <br /> to act to ban fireworks in the most effective way, a piecemeal <br /> approach is the only means available, noting that fire chiefs and <br /> , other professionals encourage the use of public f�reworks displays <br /> under appropriate conditions. <br /> MOTION: Councilman Norris moved, seconded by Councilman Barrett, <br /> to request staff to research the legality of selectively restricting <br /> sellers of fireworks to non-profit organizations and report back to <br /> Council on the result of the lnvestigat7on. <br /> The motion carried unanimously by voice vote. � <br /> , (MINUTE ORDER N0. 77-92) , <br /> MOTION Councilman Norris moved, seconded by Councilman Vega, that <br /> the City Council go on record in support of legislation which would <br /> ban all sale of fireworks on a statewide basis <br /> The motion failed on the followin9 roll call vote <br /> Ayes Councilmen Bury, Norris, Vega <br /> , Noes Councilmen Barrett, Biagi, Rhodes and Mayor Leip n g <br /> Mayor Leipzig advised that there is no pending State legislation re- <br /> lating to a fireworks ban to support, but that as Chairman of the <br /> San Mateo County Council of Mayors, she intends to sug9est a pro- <br /> gram to that group and to the Peninsula Division of the League of <br /> California Cities in order that ad�acent counties might be included <br /> also (Memo 5/3/77) <br /> Consent Calendar <br /> Councilman Norris requested that the �tem relating to funds for <br /> litigation contesting the Federal Unemployment Compensation Tax Acts <br /> be considered separately, and there being no ob,7ection, Mayor Leipzig <br /> so ordered , <br /> In response to question, C�ty Attorney Schricker advised that the ' <br /> anticipated litigat�on �s not a class action but that the Ctty <br /> would be represented as an individual party plaintiff with tfie <br /> National Institute of Municipal Law Officers serving as trustee of <br /> the funds for the purpose of litigatton.
