230 ' � <br /> ' , . <br /> summary of fire suppression activities in San Mateo County from <br /> June 1 to July 8, 1976 relating to fireworks <br /> Discussion followed and Mr Fales commented and replied to questions <br /> concerning whether an effective ban on fireworks can be accomplzshed <br /> except on a county, regional or statewide basis, the fact that organi- ' <br /> zations whose worthwhile activities are supported through the sale of <br /> fireworks have already committed themselves to obtain funds in that <br /> manner this year, the undesirability of designating City parks for <br /> the concentration of use of explosives, particularly in view of the <br /> drought conditions which prevail, the concern of citizens about the <br /> possible result of use of fireworks for the same reason, the fact <br /> that the Manager's report indicates fireworks caused considerable <br /> damage last year, although of the 22 fires, 18 were caused by illegal <br /> fireworks, the use of fireworks historically to celebrate the Fourth <br /> of July, and the need for cooperation from residents in reporting <br /> use of illegal fireworks. <br /> Councilman Bury stated for the record that people should be made � <br /> aware of their responsibilities in using "safe and sane" fireworks, <br /> and suggested those who sell them might'be required to give instruc- <br /> tions beyond that contained on the fireworks packages <br /> Discussion continued concernin9 the possibility of increase in use <br /> of presently illegal, more dangerous, fireworks if all fireworks <br /> are banned, the des9rability of strictly enforcing the ban against <br /> illegal fireworks, the difficulties involved in such enforcement <br /> and the necessity for public cooperation in reporting suspected use <br /> of illegal fireworks, and the possibil�ty of conducting an educa- <br /> tional program through the schools and recreation department <br /> MOTION Counc�lman Norris moved, seconded by Councilman Bury, that � <br /> operators of fireworks stands must have posted information which _ <br /> will attempt to bring to the attention of the purchaser the respon- <br /> sibillty he has with regard to use of the fireworks and that also <br /> an information leaflet be provided to the purchaser containing both <br /> the same information posted and a statement relating to the potential- <br /> hazards presented by the use of fireworks <br /> CHANGE OF MOTION City Attorney Schricker advised that Chapter 12 <br /> of the Municipal Code relating to Fire Prevention and Fireworks <br /> gives authority to the Fire Chief to adopt reasonable rules and <br /> regulations regarding use of fireworks and, therefore, an ordinance <br /> proposing a change in the Code would be required for the type of <br /> action contemplated by the motion Mr Schricker advised further <br /> ' that the content of the motion could be provided as information to <br /> the Fire C M ef without requiring an ordinance Councilman Norris, � <br /> with the consent of his second, then changed the motion to provide , <br /> information to the Fire Chief that a possible regulation might be <br /> establ�shed wherein the seller of fireworks would be required to <br /> provide notice of his responsibilities to the purchaser of fireworks <br /> The motion as changed carried unanimously by vo�ce vote. <br /> (MINUTE ORDER NO 77-91) <br /> Fire Chief Keller advised that a great deal of concern about the ' <br /> hazards presented by the use of fireworks has been expressed by <br /> people living in the dry hill areas, and advised that the cities of <br /> Reg.hltg -6 <br /> 5/2/77 <br /> � <br />
