Planning <br /> Director Schroeter confirmed the statement that nearly half of the <br /> lots tn the neighborhood have two dwelling units. <br /> In response to request of Mayor Leipzi9, City Clerk Hildebrand read <br /> the commu m cation of January 5, 1977 from Estelle Kelly (Zaitseff), <br /> 3040 Hoover Street, concerning the requested variance and stating <br /> that she would ob,7ect to any construction in the driveway of Mr. <br /> Stewart's property which would block certain windows in her home <br /> It was explained that the proposed unit would be constructed at the <br /> rear of the property on an alleyway, and no change is requested <br /> which would involve any construction in the driveway. <br /> Discussion followed and Mr. Stewart, Mr. Schroeter and City Manager <br /> Fales commented and replied to questions concerning the need for <br /> low income housing; the possible construction cost and rental of the <br /> proposed dwelling unit, the fact that Mr Stewart anticipates pro- <br /> viding housing in the unit for his mother, the fact that the rear <br /> alley provides access to the site, the proper use of the term <br /> "panhandle lot", the fact that the lot is zoned R-2, the similar�ty <br /> of the sub�ect property and requested variance to other lots in the <br /> neighborhood, the fact that the ordinance relating to side yard <br /> setbacks was adopted to prevent such continued development, whether <br /> or not neighbors would be sub�ect to increased tax assessment if <br /> � second units were permitted to be constructed on some properties, <br /> whether or not use of a blanket variance might be appropriate, <br /> whether any variances for such units have been granted since adoption <br /> of the related ordinance, and the fact that adequate parking will <br /> be provided on the sub,7ect site. <br /> Gilbert Ray Francis, 800 Main Street, Sequoia Hotel, called atten- <br /> tion to the letter from Mrs Kelly and urged that consideration be <br /> given to her opposition to the proposed construction It was ex- <br /> plained to Mr Francis that the second dwelling unit is proposed to <br /> be constructed on the rear of the site and would not affect Mrs <br /> Kelly's view. <br /> MOTION Councilman Norris moved, seconded by Councilman Vega, to <br /> close the public hearing <br /> The motion carried unanimously by voice vote <br /> The public hearing was closed at 8 07 p m <br /> MOTION Councilman Norris moved, seconded by Councilman Bury, to <br /> uphold the deciston of the Planning Cormm ssion and deny the request <br /> for variance of Lawrence Stewart for his property at 3048 Hoover <br /> Street. <br /> ' Discussion followed concerning the fact that granting of the variance <br /> would not create special circumstances since almost half of the lots <br /> on the street have second units and less than minimum sideyards, the <br /> family use intended for the new dwelling unit, the fact that only <br /> one variance would be required in order to permit the property owner <br /> to make use of his property, the access to the rear of the property <br /> -2- <br /> Reg.Mtg. <br /> 1/10/77 <br />
