392 ' , MOTION Councilman Siag} moved, seconded by Councilman Barrett, that the water allocation to laundromats be administered under the water emergency ordinance so that laundromats receive either a 101 cutback from the base year or the amount of water required for five cycles - per machine per day, whichever is greater AMENDMENT Councilman Barrett, with the consent of Councilman B�agi, ' amended the motion that the increased allocation be available upon request to any commercial laundromat operator � AMENDMENT WITHDRAWN Upon advice of C�ty Attorney Schricker that a due process problem would result unless all commercial laundromat operators are advised of their right to apply for increased allocation under a changed interpretation of the water emergency ordinance, Councilman Barrett withdrew h�s amendment AMENDMENT Councilman Biagi, with the consent of his second, and in response to advice of City Attorney Schricker, amended his motion to add that it is intended that the new administrative interpretation of the ordinance should apply to the appellants, Donald B. McLennan, Marsh Manor Coin Laundry and Theo Bodmer, Washing Well Laundromat It was pointed out that if the motion as amended carries and laundro- mat operators are granted an increased water allocation, they may still appeal thelr allocations. Bernice McLennan wife of Donald McLennan, partner of Marsh Manor Coin Laundry, stated that the proposed amendment is an improvement but the increased allocation might not meet laundromat needs Mayor Leipzig stated for the record that she is aware of laundromat 1 users who pay for use of those facilities to supplement the water allocation to their residences and she believes the practice is unfair The motion as amended carried by ma�ority voice vote, Mayor Leipzig determining the vote to be 5- 1 (MINUTE ORDER NO 77-199) Appeals of the denial by the Director of Public �orks of applications for increased water al1ocation - Alice Gonzales, 616 Dory Lane and Steve Yaeger, 3355 Dover Road Mr Fales referred to his report of September 8, 1977 regarding the sub�ect appeals and attaching report from the Director of Public Works dated August 26 Mr Fales advised that the report covers appeals from two individuals for increased residential water allocation, but are to be considered separately Steve Yae er, 3355 Dover Road, referred to his undated appeal letter received August 11, stating that since May 29 he has had a new baby in his home and his water needs have greatly increased. Mr Yaeger ' advised that his investigation reveals that he needs about five additional units per billing period for the baby's laundry and about 2z additional units for bathing the baby and requested an increase Reg Mtg. -4- � 9/12/77
