Czty Clerk Hildebrand reported that the Affidavit of Publication of Not�ce of Hearing is on file in her office. in response to question Planning Director Schroeter advised that it is not the intent of the proposed ordinance that the lots used for parking of new and used cars by car dealerships would be cons�dered as parking lots, and acknowledged that the wording of paragraph (a) may be unclear, although dealerships are a distinct business and not cons�dered parking lots. In further response to questions from Counc�l members and City At�torney Schricker, Mr. Schroeter advised that the purpose of the proposed ordinance is to prov�de authority to the City to clean up vacant lots where cars are parked or stored, often without the consent of the ' property owner; that property owners would not be required to pave and stripe the lots unless they wish to use them for parking lots, that commerc�al parking lots are not allowed in res�dential districts unless tihey are part of an apartment development, that there has been public demand that the improperly used lots be cleaned up, that simi- lar ord�nances have been adopted in nearby cities, that consideration has been given to c�her methods of handl�ng the matter such as en- forcement of the abandoned veh�cle laws, noting that the cars are not abandoned; and that damage is done resulting in broken curbs and sidewaiks and street maintenance and clean-up problems � Mayor Leipz�g invited anyone present who wished to speak to do so No one wlshed to speak. MOTION Councilman Norris moved, seconded by Councilman Rhodes, to � close the public hearing . The motion carried unanimously by voice vote. The public hearing was closed a� 8.14 p m City Attorney Schricker recoriunended that the proposed ordinance be returned to staff for redrafting and revisions which would incor- porate some of the remarks made with regard to interpretation. Mr ' Schricker advised that since the hearing has been held, and if there is general agreement, the proposed ordinance could be placed on the Consent Calendar at the next Council meeting. -3- Reg Mtg , _ 3/14/77
