� �� <br /> Maloney commented concerning his discussion with Mr Tyson regarding <br /> his status and Mr Schroeter advised that Mr Tyson is converting <br /> an existing building at 88 Claremont to 8 condominiums It was <br /> determined that Mr Tyson has Tentative Map approval, the Conditions, <br /> Convenants and Restrictions are in process and Final Map is expected <br /> within 30 days It was pointed out that the proposed ordinance will <br /> ' not go into effect until 30 days after its adoption <br /> Irving H Kaye, owner of property at 1019 Fifteenth A�venue, stated <br /> he is constructing a duplex which he intends to convert to condo- <br /> mtnium ownership Mr. Kaye referred to his letter to Council of <br /> April 26, 1978 (The letter �s on file in the Office of the City <br /> Clerk ) In response to question as to why he did not apply for a <br /> permit to construct a new condominium rather than for a duplex <br /> permit in view of his stated plan for the building, Mr. Kaye advised <br /> that he made application for a duplex permit because of the ordinance <br /> adopting zoning changes last year which would have caused his lot <br /> to be less than the minimum size required for a duplex. <br /> Discussion followed and Mr Schroeter commented and replted to ques- <br /> tions regarding the fact that no specific limit applies to number <br /> of units in new condominiums since other factors are involved, <br /> whether duplex unit on a substandard lot could reasonably expect <br /> ' to be developed as a condominium, the possibility of Mr Kaye and <br /> another party owning the duplex as tenants in comnon rather than <br /> converting to condominium ownership, the concern that permitting <br /> conversion of a duplex might set a poor precedent in view of the <br /> many duplexes existing in Redwood City, State requirements regard- <br /> tng the Subdivision Map Act and parcel maps, the desirability of <br /> spreadin9 the assumption of risk by condominium owners in setting a <br /> ' minimum number of units, and the fact that the marketplace tends <br /> to determine the kinds of units which are constructed. <br /> MOTION Councilman Norris moved, seconded by Councilman Biagi, to <br /> adopt the previously approved ordinance relating to condominium con- <br /> version of apartment buildings with the amendment that the mtnimum <br /> number of units allowed to be converted be changed from 12 to five <br /> The motion failed on the following roll call vote <br /> Ayes Councilmen Biagi, Leipzig, Norris <br /> Noes Councilmen Bury, Chandler, Mayor Barrett <br /> CHANGE OF VOTE There being no ob�ection, Mayor Barrett changed <br /> his "No" vote to "Aye" on the motion. <br /> The motion then carried on the following roll call vote. <br /> Ayes Councilmen Biagi, Leipzig, Norris, Mayor Barrett I <br /> Noes Councilmen Bury, Chandler (MINUTE ORDER N0. 78-108) <br /> City Attorney Schricker advised that in view of the substantial � <br /> change in the number of units to be permitted, the proposed ordi- <br /> ' nance must be readvertised and will be considered for final adoption <br /> following such advertisement. <br /> -8- Reg Mtg. <br /> 5/1/78 <br />
