He <br /> pointed out that if the homeowner perceives a dangerous condition <br /> on the sidewalk, it is incumbent upon him to removP it rather than <br /> expect the City to do so Mr. Schricker advised that there is a <br /> procedure for filing an application to remove a street tree, but <br /> ' the permit may not be granted, not�ng that the reasons such trees <br /> are planted by the City is for beautification of neighborhoods <br /> and enhancement of the env�ronment. <br /> (Council recessed from 11:05 to 11:30 p.m.) <br /> ti <br /> Mayor Sarrett announced that consideration of the Human Serv�ces <br /> Program of the Alternate Budget will be given at 7.30 p.m., Tuesday, <br /> June 13, 1978 at a budget study sess�on to be held in the Board of <br /> Supervisors Chambers. <br /> Discussion continued concern}ng street trees and whether or not any <br /> emergency legisla��on would be necessary to make it possible to charge <br /> fees for trimm�ng. <br /> John Murphy, 421 Luff Lane, inquired concerning the emergency, and <br /> was advised that an emergency may exist with regard to the fiscal <br /> s�tuation in the City, but no particular physical disaster is <br /> �nvolved at this time. <br /> City Attorney Schricker advised that certain findings m�ght have to <br /> be made regarding the health, safety and wlefare of the cormnunity. <br /> In response to question, City Manager fales advised it is the inten- <br /> tion of staff that wherever possible vacant pos�tions will be filled <br /> , by employees whose positions are being eliminated, noting that it <br /> has not yet been poss�ble to match them <br /> In response to question regarding the effect of recreation cutbacks <br /> on the $100,000 bequest of Sidney Herkner which was to have been <br /> used for the camnunity swirtening pooi, Mr Fales advised that the <br /> Committee handling Mr Herkner's estate and possibly the courts, <br /> would have to be advised that the City cannot meet its obl�gation <br /> and the bequest would have to be returned. y <br /> Discussion followed concerning the possibility of allowing use for a , <br /> fee of the Corrmunity Activities and Veterans Memorial Buildings <br /> when they are not open to the public since hours are being cut, and <br /> whether some groups, such as senior citizens, might not be will�ng <br /> , and able to handle their own events <br /> MOTION• Councilman Chandler moved, seconded by Councilman Bury, to <br /> make funds available so that the lease of the LeBlanc and Brizee <br /> propert�es for park use could be continued in a part of the City <br /> which is without much park space <br /> Discussion followed concerning the cost to iease and maintain the <br /> properties, the neighborhood they serve, the source of funds proposed <br /> to be used to lease and maintain them, whether a second look at the <br /> ' ' -5- <br /> Budget <br /> Study Budget <br /> 6/10/78 Study <br /> 6/10/78 <br /> F <br />
