Mr. Fales recortmiended the , <br /> contract be awarded to American Rubber Manufacturing Company on <br /> the basis of their low proposal in the total amount of $5,974.69. <br /> MOTION: T�tle having been read, Councilman Vega �ntroduced the <br /> following resolution and moved, seconded by Councllman Bury, its <br /> adoption <br /> RESOLUTION N0. 8029 AWARDING CONTRACT FOR THE FURNISHING OF <br /> THREE 3 FIRE HOSES, REJECTING ALL OTHER BIDS RECEIVED, <br /> AND AUTHORIZING EXECUTION OF AGREEMENT FOR THE FURNISHING <br /> . THEREOF <br /> The resolution was adopted unanimously by roll call vote. <br /> Report on proposed annexation of <br /> approximatelY 0.93 acres, Upland Road <br /> City Manager Fales referred to h�s report of March 24, 1978 re- <br /> garding the sub�ect proposed annexation and attaching the staff <br /> report of the Local Agency Formation Commission (LAFCO) dated <br /> March 8. Mr. Fales advised that he has recommended the Council <br /> take no action with respect to the sub�ect annexation, noting that <br /> LAFCO may then adopt a resolution certifying to the Board of <br /> Supervisors that the City has fa�led or refused to in�t�ate, conduct , <br /> and complete annexation proceedings He advised further that upon <br /> receipt of the LAFCO resolution, the Board must then assume �uris- <br /> diction and initiate, conduct and complete the necessary annexa- <br /> tion proceedin�s. Mr Fales noted that City Attorney Schricker <br /> has advised that the City might retain some small control in the <br /> matter by holding a public hearing and determining the proposed <br /> annexat�on would not be in accordance with Council policy of 1974 <br /> not to annex. <br /> City Attorney Schricker advised that the City may initiate pro- <br /> ceedings, publish the matter for hearing, hold the hearing and <br /> determine that no evidence has been presented which would cause <br /> Council to change its 1974 policy against annexations Mr. <br /> . Schricker noted that in taking no action, Council might be waiving <br /> rights regarding the ability t� terminate annexation proceedings. <br /> He observed thar representatives of the City d�d report at the , <br /> LAFCO hearing and recommended denial, noting that utilities are <br /> not planned for the sub�ect area and that, with one exception, <br /> similar requests have been denied by the City Council since 1974 <br /> Discussion followed and Mr. Fales and Mr. Schricker commented and <br /> replied to questions concerning the political nature of the annexa- <br /> tion situation, whether or not the City can be compelled to annex <br /> land contrary to Council policy not to do so, the desirability of , <br /> hav�ng the matter considered by other cities in the County, the <br /> possibility of making the annexation initiation procedures an <br /> example of the kind of wasted t�me and effort the City is driven <br /> to undertake, the reasons for the establishment of LAFCO and the <br /> Reg Mtg. -3- <br /> 3/27/78 <br /> I�� , <br />
