MOTION: T�tle having been read, Councilman Vega �ntroduced the following resolution and moved, seconded by Councllman Bury, its adoption RESOLUTION N0. 8029 AWARDING CONTRACT FOR THE FURNISHING OF THREE 3 FIRE HOSES, REJECTING ALL OTHER BIDS RECEIVED, AND AUTHORIZING EXECUTION OF AGREEMENT FOR THE FURNISHING . THEREOF The resolution was adopted unanimously by roll call vote. Report on proposed annexation of approximatelY 0.93 acres, Upland Road City Manager Fales referred to h�s report of March 24, 1978 re- garding the sub�ect proposed annexation and attaching the staff report of the Local Agency Formation Commission (LAFCO) dated March 8. Mr. Fales advised that he has recommended the Council take no action with respect to the sub�ect annexation, noting that LAFCO may then adopt a resolution certifying to the Board of Supervisors that the City has fa�led or refused to in�t�ate, conduct , and complete annexation proceedings He advised further that upon receipt of the LAFCO resolution, the Board must then assume �uris- diction and initiate, conduct and complete the necessary annexa- tion proceedin�s. Mr Fales noted that City Attorney Schricker has advised that the City might retain some small control in the matter by holding a public hearing and determining the proposed annexat�on would not be in accordance with Council policy of 1974 not to annex. City Attorney Schricker advised that the City may initiate pro- ceedings, publish the matter for hearing, hold the hearing and determine that no evidence has been presented which would cause Council to change its 1974 policy against annexations Mr. . Schricker noted that in taking no action, Council might be waiving rights regarding the ability t� terminate annexation proceedings. He observed thar representatives of the City d�d report at the , LAFCO hearing and recommended denial, noting that utilities are not planned for the sub�ect area and that, with one exception, similar requests have been denied by the City Council since 1974 Discussion followed and Mr. Fales and Mr. Schricker commented and replied to questions concerning the political nature of the annexa- tion situation, whether or not the City can be compelled to annex land contrary to Council policy not to do so, the desirability of , hav�ng the matter considered by other cities in the County, the possibility of making the annexation initiation procedures an example of the kind of wasted t�me and effort the City is driven to undertake, the reasons for the establishment of LAFCO and the Reg Mtg. -3- 3/27/78 I�� ,
