263 <br /> Parking Violation Bail Schedule <br /> City Manager Fales referred to his report of January 23, 1976 <br /> on the sub,7ect schedule to which is attached a cortmunication <br /> from Wilbur R. Johnson, Chairman, Municipal Court Judges, San <br /> Mateo County, indicating the intention of the courts to increase <br /> ' the parking violation bail schedule throughout the County to <br /> $5.00, effective February 1, 1976, unless individual �urisdic- <br /> tions request another bail schedule. Mr. Fales reported on the <br /> plans of nearby cities wtth regard to the schedule, noting that <br /> most are expected to reta�n their $2 00 bail. He advised that <br /> the City must respond to Judge Johnson whether or not a change <br /> is to be made and observed that cost to the City to enforce <br /> parki�g violations is about $3 00 per violation <br /> Discussion followed concerning the desire to improve business in <br /> the downtown area, whether the $5.00 bail to be used in the County <br /> might drive customers away from the downtown area, whether a nomi- <br /> nal bail does not subsidize those who monopolize parking space <br /> to the detriment of potential customers since turnover may be <br /> decreased; the cost to process a parking violation, and the pos- <br /> sibility of increasing the bail schedule to $5.00 and using any <br /> excess to pay off the bonds for the parking meters, thereby <br /> eliminating all of them from the downtown area. <br /> City Attorney Schricker advised that it should be understood <br /> that the $2.00 or $5.00 is bail and not a fine. Mr. Schricker <br /> advised also that all parking bonds would have to be retired at <br /> the same time, not selectively, so that any residual resulting <br /> from a higher bail than the $3.00 cost of enforcement could not <br /> be used for that purpose <br /> ' Bob Fili one, 2360 Broadway, President of the Merchants Associa- <br /> tion, state a poll of the downtown merchants reveals about 85% <br /> favor not increasing the bail above the present $2.00, 10% favor <br /> raising it to $3.00 and the rest have no opinion.
