3. The Grantee shall not, except as permitted by the DDA, sell, transfer, convey, <br /> assign or lease the whole or any part of the Site without the prior written approval of the <br />- Grantor. This prohibition shall not be deemed to prevent the granting of easements or <br /> permits to facilitate the development of the Site or to prohibit or restrict the leasing of any <br /> part or parts of a building or structure when said improvements are' completed. <br /> <br /> 4. Subject to the provisions of Section 512 of the DDA, the Grantor shall have <br /> the additional right, at its option, to repurchase, reenter and take possession of the Site hereby <br /> conveyed, or such portion thereof, with all improvements thereon, if after conveyance of title <br /> and prior to issuance of a Certificate of Completion for development and construction upon <br /> the Site, the Grantee or successor in interest shall: <br /> <br /> a. Fall to proceed with the development and construction of the <br /> improvements as required by the DDA for a period of three (3) months after written notice <br /> thereof from the Grantor; or <br /> <br /> b. Abandon or substantially suspend development or construction of the <br /> improvements for a period of three (3) months after written notice of such abandonment or <br /> suspension from the Grantor; or <br /> <br /> c. Transfer or suffer any involuntary transfer of the Site, or any part <br /> thereof, in violation of the DDA. <br /> <br /> Such right to repurchase, reenter and repossess, to the extent provided in this <br />-- paragraph 4, shall be subordinate and subject to and be limited by and shall not defeat, render <br /> invalid or limit: <br /> <br /> d. Any mortgage, deed of trust or other security instrument permitted by <br /> the DDA; or <br /> <br /> e. Any rights or interests provided in the DDA for the protection of the <br /> holder of such mortgages, deeds of trust or other security instruments. <br /> <br /> 5. Subject to the provisions of Section 513 of the DDA, the Grantor shall have <br /> the right, at its option, to reenter and take possession of the Site hereby conveyed, or such <br /> portion thereof, with all improvements thereon, and revest in the Grantor the estate conveyed <br /> to the Grantee, if after conveyance of title and prior to issuance of a Certificate of <br /> Completion for development of and construction upon the Site, the Grantee or successor in <br /> interest shall: <br /> <br /> a. Fall to proceed with the development and construction of the <br /> improvements as required by the DDA for a period of three (3) months after written notice <br /> thereof from the Grantor; or <br /> <br /> <br />
