City Attorney McCazthy dictated an addit- ion to thi's resolution in regard io thie agreement which was to be incor- porated therein. On roll oall, reeolution wae unanimously adopted with � Councilmen Andereon and Britschgl absent. The agreement in regard to the drainage struoture was to be added to the petition to haoe the work as well as in the reso'lution. REBOLUTION No. 296 ORDERING PLAN9 AND SPECIFICATIONS RED4GOOD TERRACE N0. 1 RE30LVED, by the Council of the City of Redwood City, California, that ' WHEREA3, requeet has been made on behalf of the owner of the property in Redwood Terrace No, 1 to be aeseseed for these proceedings, that pro- ceedings be undertaken by the City under the Redwood City Improvement Pro- cedure Code No. 333, for the construction of the improvements aubstantially as deacribed in the petition for eaid vuork filed with the City Clerk, and to aesess the cost and espenses thereof upon the property beneYitted there- by, including the lands within said subdivision, tagetner wfth the inci- dental expenses to be aesessed as an incidental expense in said proceedings, said coste and expenses is not otherwise to be charged against said City; and WHEREAB, it ie necessary in the �udgment of tne Oity Oouncil that a • etorm drainage structure be constructed concurrenrly with the improvementa nerein contemplated from the eaeterly edge of trie property known ae Redwood ' Terrace No. 1 to connect witn an outlet of an open ditch on or near Oak Avenue in the Oity of Redwood City and that the coet of auch etructure ahould be apportioned between property within the City and trie area of Redwood Terrace No. 1, as hereinbefore etated; NOY1, THEREFORE, IT I9 ORDERED, that the City Engineer be and he ie hereby directed to prepare the preliminary eurvey, plans and apecificatlons, an estimate of cost, and to do and perform all other engineering auork ' neceseary in eaid proceedinge, including the preparation of the diagram and assesements for the coet thereof upon its completion, and to employ such engineering aseistance ae is necesse.ry in the conduct of said proceedings and to assess the cost tnereof as an incidental expense of said proceedinge; IT IS F ORDERED tnat the cost of such sernice drainage structure hereinabove referred to be divided as followe: Seventy-five per cent (75'�0) of the coat thereof a$ainet property within Redwood Terrace No. 1, and twenty-five per cent (25°�) againet property benefitted thereby and within the City of Rede�ood City, prior to the annexation of the property generally ' known as the Garson-Monckton Tract.
