It wae disoovered that some years ago, in 1927, the Council had <br /> agreed to let him connect to the city sewere and to furnieh water service. <br /> It did not etate in the minutes of the meeting in April, 1927, whether the <br /> a�reement wae to cover one home or more, City Mana.ger Blom aeked Council- ' <br /> man MeNulty if he recalled tne agreement, Councilman McNulty did so but <br /> C wae unable to say whether the agreement covered an individual home or sev- <br /> eral homes. Mr. 9Pilliams adviaed that he contemplated building seventeen <br /> homes in this area. It wae the general conaeneus of the Council that Mr, <br /> Williame ehould petition to come into the city limite inasmuch ae it wa,s <br /> believed that the city wae not in a position to offer exteneion of aervicee <br /> .;._.. , <br /> outside the city limite. Due to tne fact that Mr. Williame had not taken <br /> � advantage of the agreement entered into in 1927 up to this time, the Coun- <br /> n cil did not feel that it was obligated to etand by thie agreement, Coun- <br /> ■ cilman Fletcher moved, eeconded by Councilman Armstrong, that due to the <br /> : fact that the citq eewers are overloaded and the property in question ie <br /> ,outaide the city limits, the request of Mr, Williams be denied, Motion <br /> paesed.unanimously, <br /> Mr. Ingeraoll explained triat the amendment to Ordinance No. 515 pzovided for a <br /> new section, Ae stated that tne 1913 8tate Aqt had proven cumbersome in <br /> � recent yeare $ nd that in 1941 it veas amende&tto;°�provide that where 85�6 <br /> of property ownere within a proposed improvement district petitioned the <br /> governing body to go ahead with the work that the inveatigation proceedings <br /> could be dispeneed with, The proposed amendment to the ordinanoe, he said, <br /> . �complies witn the pronision in the 8tate Act, Councilman Britscngi asked. <br /> �I if tais provision would eliminate the resolution of preliminary intention <br /> �� to which Mr, Ingereoll replied that it did upon petition of 85�6 oY the <br /> affected property ownera, Cotmcilman Armstrong asked if the method was nmt <br /> an alternate procedure and did not supersede Ordinance No. 515, City Attor- <br /> .ney McCarthy agreed this wae eo.
