<br /> visable to have the title companies handle the complete transaction and
<br /> moved that the City Attorney be instructed to close deals relating to the con
<br /> demnation suit for the recreation area through the title comaaniec in tne
<br /> ; regular vaay, seconded by Councilman :`lerder. h�ot ion passed unanirnously.
<br /> Councilman Armstron� moved, seconded by Councilman Britschgi, filing of affidavit
<br /> of mailing and posting of notices of hearing on proposed improvernents on
<br /> Sapphire, Taft, Ruby Streets, etc. �otion passed unanimously.
<br /> There were no protests and Councilman Armstrong offered resolution and
<br /> � moved its adoption of resolution of preliminary determination to make improve
<br /> • ments on Sapphire, Taft, Ruby Streets, etc. The motion was seconded by
<br /> Councilman Granger and on roll call resolution was unanirnously adopted.

<br /> RESOLVED, by the Council of the City of Redwood City, California, that
<br /> 1i'HEREAS, on the 6th day of �iay, 1946, this Council adopted Resolution
<br /> - No. 313 entitle¢ "Resolution of Preliminary Determination to &fake Public
<br /> ' Improvements in Sappnire, Taft and Ruby Streets" to construct certain pub-
<br /> lic improvements more particularly therein described and did fix Monday
<br /> the 20th day of May, 1946 at 8 o'clock p.m, at the Council Chambers in the
<br /> City Hall in said City as the time and place v�hen and ti�here any and all
<br /> persons interested may appear and show cause, if any they have, why the City
<br /> �Council should not find and determine that the public convenience and nec-
<br /> essity require the improvements deacribed and referred to in said Resolution
<br /> v�ithout compliance with the Specia.l Assessment Investigation, Limitation and
<br /> ?�ajority Protest Act of 1931; and
<br /> �IHEREAS, notice of the adoption of said.Resolution of Preliminary De-
<br /> termination and of said time and pla,ce of hearing was given by the City
<br /> Clerk by publication and posting for the time and in the manner'provided in
<br /> said Resolution and in Ordinance No. 515 of said City, as appears from
<br /> affidavits on file with the City Clerk; and
<br /> � F7HEREA5, no v�ritten objection to the undertaking of said proceedings
<br /> N�ithout first complying vaith the provisions of said Investigation Act has
<br /> been filed vaith tne City Clerk at or before the time fixed for this hearing
<br /> by persons interested, ovrning or ha,ving an interest in real property within
<br /> the assessment district, bearing their signatures, a description of their �
<br /> property, and a state:nent of the nature of this interest therein; and
<br /> FYHEREAS, all persona interested have been given an opportunity to be
<br /> and were fully heard, and said Council has duly considered any a.nd all ob-
<br /> ' jections improvements, and the public convenience and necessity for making
<br /> sarne.
<br /> NO�ti, THEREFORE, IT IS FOUND, DETEr'?�fINED AND ORDERED, as follov�s:
<br /> 1. That the public convenience and necessity require the improvements
<br /> described in said Resolution of Preliminary Determination.
<br /> 2. That any and all obj,ections and protests made pursuant to said
<br /> � Resolution of Preliminary Determination be and the same are hereby over-
<br /> ruled and de!�ied.
<br /> 3. That the improvements described in said Resolution be made under
<br /> and pursuant to the provisions of the.Red�vood City Ordina.nce P1o. 333, and
<br /> that the Special Asseasment Investigation; Limitation �.nd Majority Protest
<br /> Act of 1931 sha11 not apply to said proceedings.
