Under the queetion, Councilraan Granger aeked if_there were any <br /> legal entanglemente in making the award to Seagrave inasmuch as they were <br /> not the actua,l lowest bidder. City Attorney McCarthy advised there were <br /> no legal entanglementssto be encounteied,. it being hie opinion that the <br /> Council was entitled to take into consideration the various aspecte of � <br /> tlie equipment in determining the moat satisfactory, particularly in view <br /> of the fact that tue Seagrave Corporation would turn the old equipment <br /> back to the city. Councilman Andereon believed that this pronision ehould <br /> be included in the motion, Councilman Armstrong asked if there were any <br /> legal obligation on the part of tne Council to accept a low bid. Oity 0 <br /> Attorney McCarthy advised that the Council can reject all bide if it de- <br /> siree and did not believe there wae any legal obligation to accept the <br /> low bid but believed the Council was entitled to accept the best bid and <br /> tha,t it might be assumed that the best bid is the lowest bid. Councilman <br /> Granger asked if the award had been recommended on a point syetem to whioh <br /> City Manager Blom replied that a point system nad not been used but that <br /> it had been a matter of good judgment, He did.not believe"there was any � <br /> `" obligation to accept a low bid on piecee of equipment which have to meet <br /> specificatione. Councilman Fletcher changed nia motion to include the <br /> proyision tnat the city manager be instructed to negotiate further with <br /> the Seagrave Corporation in regard to retaining the old equipment and <br /> that there be received from the Seagrave Corporation an agreement in <br /> writing that tue oity will be allowed to retain the old equipment, In <br /> anawer to Mayor Hilton�s question as to the delivery date, City Manager <br /> Hlom replied that 9eagrave Oorporation had agreed to deliner by September � <br /> 1,'1946, contingent on strikee and other things over which they have no <br /> control, Councilman Granger stated that the bid was being awarded to <br /> 8eagrave with the understanding that every attempt was to.be made to dis- <br /> �ose of the olci equiprnent. C3ty Il�ianager Blom adviaed that wa.s the <br /> underetanding, The motion passed unanimously. � <br /> City Manager Blom advised that notices had been sent out to property ovuners <br /> involved in regard to installing an 8° water main on Bayahore:,Higha�ay out <br /> to a point near the Red Feather Products Company. The property owners <br /> were aeked to indicate whether or not they would be interested in having � <br /> a line inst,alled and vuhether they would be willing to pay their portion <br /> ""� of the assessment to cover approximately two-tnirds of the coet tnereof, <br /> tne city to stand the otaer one-thfrd, Nine responses have been received <br /> out of seventeen notices sent and eight have been unfavorable. Others <br /> are awaiting inforrnation from the ineurance agente ae to poasible savings <br /> �. <br /> in insurance rates. Qity Manager Blom asked that the matter be carried <br /> I <br />
