Mayor Hilton a,sked if it is legal to �' <br /> �� <br /> accept the final map of Eaton Avenue Villas. Mr. McCarthq pointed out �' <br /> that it was not in conYormity with the Subdivision Ordinance, but that the ' <br /> area is in a remote part of the City and that he believed that a.n excep- <br /> tion was discretionary with the Council and requirements of the 3ubdivi- <br /> sion Ordinance can be waived, Mr. Randlett suggested filing the map as <br /> a resubdivision of the original subdivision. On motion of Councilman <br /> McNulty, seconded by Councilman VJerder, the City Clerk was instructed to ' <br /> sign the final map of Eaton Avenue Villas, waiving requirements for side- <br /> walks, curbs, gutters and minimum standard street construction, upon the <br /> condition that the City has no liability ever to repair or araintain <br /> Eaton Villa Place. <br /> CONTROL OF TRANSIENT BUSINESS: Communication was received from Don Shapero, • <br /> P1. Keith Cole, Lionel T. Berryhill and Maurice G. PJeaver as members of <br /> the Professional Photographers Association of the Peninsula s,uggesting <br /> revision of Business Licenae Ordinance No. 319 to control unethical <br /> and irresponsible business practices. On motion of Councilman Granger, <br /> seconded by Councilman McNulty, City Attorney McCarthy was instructed to <br /> prepare a suitable amendment. Mayor Hilton pointed out the need for <br /> other possible amendments, and Councilman Granger amended his motion to ' <br /> include other typea of business requiring similar regulation, Motion <br /> carried as amended. <br /> TAXICAB ORDINANCE, AMENDMENT, Introduction of: Councilman tYerder introduced <br /> Ordinance Amending Section 6 of Ordinance No. 535 Regulating the Use and <br /> Operation of Taxicabs to omit residence qua.lifications of chauffeurs, <br /> seconded by.C.,ouncilman McNulty. Motion passed unanimously. City L4anager ' <br /> Blom said that the inatallation of ineters is scheduled for 8eptember 18, • <br /> 1946, unless conditione make it impossible. Mayor Hilton asked how <br /> many taxi spaces Luxor cab had on Main Street and said that three were <br /> in use. Pdr. Blom said that some of this space ia unused bus-stop curb, <br /> but that unused bus-atops will be eliminated when the question of routing <br /> buses has been solved. ' <br /> ORDINANCE GRANTING U8E VARIANCE. Discussion: Councilman Granger auggested <br /> that when use variance is appied for notice be given property owners <br /> within 275 feet by the same procedure followed in applications to re- <br /> zone. Councilman Ar:nstrong said that in his opinion the use variance � <br /> gr�nted in Arch Street does not fulfill the conditiona of the ordinance, ' <br /> City Attorney McCarthy stated that, while there was no final dieposi- <br /> ' tion of the Arch Street variance by the Planning Commission, the ques- <br /> tion of conformance is one of judgement; that there is no detriment to <br /> other property owners, and only one obj'ection, later withdrawn, was <br /> made to the granting of the,variance; that the Council exercised its � <br /> discretion in the granting of the va,riance; tha,t a public hearing was . , <br /> . � <br />
