Councilman Fletcher moved, aeconded <br /> by Councilman McNulty, introduction of the ordinance granting an easement <br /> over Chestnut Street and Bay Road, Under the question, Councilman Hritschgi <br /> raised the question as to wnether ten feet would be aufficient to allow <br /> for ciearance. There was coneiderable discussion on this matter and it � <br /> was finally decided that instead of specifying ten feet the amount of the <br /> easement would be the minimum amount acceptabel to the Ra.ilroad Commieeion. <br /> Motion passed unanimously, � <br /> Communication w�s received from John M, Robo requesting tnat tne Council pass <br /> an ordinance establiahing setback linea on all landa adjoining or adjacent � <br /> to Pennsylvania Avenue on the northeasterly side from the.easterly line <br /> of Winslotiv Street to the northwest:eTly.lirie of Spruce Street to a distanoe <br /> .of not less then forty feet. The City Attorney was aeked to gine a report <br /> on the status of Pennsylvania Avenue, City ?.ttorney MeCa.i.thy�aadvie:ed�-tnat <br /> he believed the title to Pennsylvania Avenue ie in the Souther Pacific <br /> Comnany, The title company is in doubt about the title, Mr. �cCarthy ex- <br /> preased the opinion that it would be very difficult to establish title to � <br /> tkiis street. He euggeated that the title company might be asked'for a <br /> report. Councilman Granger wae of the opinion that a definite anewer <br /> euould be had in the matter. Qouncilman Fletcher moved, seconded by Council- <br /> man Britechgi, tha,t the City Manager be instructed to get a report from the <br /> title company as io the status of Pennsylvania Avenue including all of <br /> Penneylvania Avenue down to 3pruce Street, Motion paesed unanimovaly, <br /> City Manager Blom advised tnat ne nad been instructed to find out what steps were � <br /> necessary'in ordeT to permit the starting of improvemente in the firet por- <br /> tion of the Carson-Monckton Tract. It was his understardin� that tne firsti <br /> thing that must be done is to file a map of the firet area which the eub- <br /> dividers propose to develop together with some form of guarantee that the <br /> street Rork will be done in accordance uvitn city requirements, It will be � <br /> necessary that a bond be posted or some other method of security agreeable <br /> to the Oouncil. The proceedinge would be carried out under the 1911 Bond <br /> Act, He believed the city ahould have a quarantee covering the prelfminary <br /> engineering and legal assistance wniCh should total about �5000. A portion <br /> of that swn kas already been advanced to A�r, �Jillis Frost. For the re- � <br /> mainder of the work to be done, he said he would recommend that the city ask <br /> for an additional �4000 to be advanced which would cover the additional <br /> work to be done by Mr, Frost and the cost oP the proceedings, Fie sa3d it <br /> would be necessary to make a change in the tentative man as eubmitted so <br /> tnat eome additional lots will be included.
