, ��� <br /> • RE$OLUTION No.'25`7 ' <br /> DETERldINING TO MABE IMPROVEMENT WITHOUT COMPLIANCE VPITH INVE3TI'- <br /> GATIONw ACT. <br /> RESOLVED, by the Council of the City of Redwood City, California, that <br /> WHEREAS, on Deoember 1'7, 1945, thie Council adopted ite Reaolution oi <br /> Preliminary Detex^nination No. 256 to conetruct certain public'improvementa <br /> more particularly tnerein described, and did fix therein this date ae the <br /> ' time and place when and where any and all persons interested may appear and <br /> snow cause, if any tney have, why the city council ehould not find and <br /> determine that tne public convenience and necessity require the improvemente <br /> deecribed and referred to in said resolution, without compliance with the <br /> Special Assessarent Investigation, Limitation and Majority Protest Aot of <br /> 1931; <br /> YPHEREAS, notice of the adoption of said preliminary reeolution and of <br /> said time and place of•hearing was given by the City Cler& by publication <br /> ' and posting for the time and in tne manner provided in said resolution of <br /> preliminary determination and Ordinance No. 515 of said City, as appeare <br /> from allidavits on file with the City Clerk; <br /> l9HEREAB, No written ob�ectione to the undertaking of said proceedings <br /> without first complying with tne provisione of said Innestigation Act have <br /> been filed with the Citq Clerk at or before the time Yixed for this hear- <br /> ing by persone interested, owing or having an interest in real property <br /> witnin the proposed assessment district, bearing their signatures, a <br /> description of their property, and a etatement of the nature of tneir in- <br /> terest therein; and <br /> • 9PHEREA3, all persons interested nave been given an opportunity to <br /> be and were fully heard, and said council has duly considered anq and all <br /> objections and proteats made, and the said proposed improvements, and the <br /> public convenience and neceasity for making same, <br /> N0�9. THEREFORE, IT IS FOUND, DETER3dINED AND ORDERED, ae followe: <br /> 1. Tuat tne publie convenience and neeeseity require the improcements <br /> described in said Resolution of Preliminary Determinaiion. <br /> 2. Phat any and all objections and protest made pursuant to said <br /> resolution of preliminary determination be and the same are hereby over- <br /> '' ruled�and denied; <br /> 3. City Attorney <br /> McCarthq also advised that Mr. Wilson,:attorneq in the proceedings, had <br /> aeked if it would be agreeable to imploy Mr. 9�illis Frost to prep�.re the <br /> plane and epecificatione for work, Acting City Engineer Aandlett advised <br /> that City Manager Blom and Frost had conferred on thie and it wae more or <br /> less agreed that Mr. Frost would do the work, inaemuch as the city engin- <br /> • eering department wae too busy. City Attorney MeCarthy advised in answer. <br /> � <br />
