Gentlemen: � The local hospital committee has asked my opinion as to the power, or right of the City Council to appropriate approximately �2,100.00 to reim- burse the county of San Mateo for the expenses necessarily incurred in an election to be neld for the puroose of organizing a local hoepital district in case the election ehould be adverse to the organization of the diatrict. The expenses estimated are approximately �2,100.00. If the election carriea and the district ie org�,nized, trie Board of Supervieors will meet � the expensea by an assessment against the property o£ the district of the County, but if the dietrict is not organized, the County will want insur- ance that it will be reimbursed for the expenses above mentioned. In the firat place we must assume that this election is for the pur- pose of bringing about the organization of a district which will engage in a public activity in.distinction from a private activity, A city acting under a.charter has a11 general powers for the mana,gement of its local municipal affairs that are not prohibited to it.
