significant environmental effect would occur, and there is no substantial evidence in light of the whole <br />record before the Redevelopment Agency Board that the Project, as revised, may have a significant <br />environmental effect. <br /> <br />Facts in Support of Finding <br /> <br />The City has adopted Mitigation Measures 6-1 through 6-3 of the Franklin Street Area Plan EIR and <br />New Mitigation Measures 4 and 5, identified on pages 3-21 through 3-22 of the Initial Study, to reduce <br />potential hazards and hazardous materials impacts to a less-than-significant level: <br /> <br />The effects of these mitigation measures will be to require site assessment and remediation of potential <br />hazardous material sites prior to allowing construction to commence. Implementation of these <br />measures will minimize any adverse hazards and hazardous material impacts that could occur with site <br />redevelopment. Because adverse hazards and hazardous material impacts will be avoided with <br />implementation of these mitigation measures, no significant impacts will occur with site redevelopment. <br /> <br />NOISE (Section XI) <br /> <br />SIGNIFICANT EFFECT <br /> <br />Impact <br /> <br />The Redevelopment EIR concluded that development within the Second Amendment area could <br />adversely affect the noise environment along major access roads. The City considered the merits of the <br />Redevelopment Plan in light of the significant noise impacts during the approval process for the Plan. <br /> <br />The Franklin Street Area Plan EIR evaluated noise level increases associated with Project traffic at <br />eight roadways within the Project area. The greatest increase (5 dB CNEL) was anticipated to occur on <br />El Camino Real. The EIR concluded that this would not be considered a significant impact. <br /> <br />The proposed Project will not include any changes in the previously evaluated redevelopment activities <br />that will cause any new significant noise effects or substantial increases in the severity of previously <br />identified noise effects. The construction activities identified in the Redevelopment EIR will not <br />substantially differ with the proposed Project, and thus, no incremental increase in construction noise <br />will occur. For operational emissions, the proposed Project will include fewer residential units (506 <br />vs. 527) than identified in the Franklin Street Area Plan, therefore, vehicle traffic and associated noise <br />levels would be less than anticipated in the Franklin Street Area Plan EIR. For this reason, the <br />incremental noise impacts of the proposed Project are not considered significant. <br /> <br />Findine <br /> <br />The Redevelopment Agency Board finds that changes or alterations have been incorporated into the <br />Project which mitigate or avoid the significant noise impacts to a point where clearly no significant <br />environmental effect would occur, and there is no substantial evidence in light of the whole record <br />before the Redevelopment Agency Board that the Project, as revised, may have a significant <br />environmental effect. <br /> <br />Facts in Support of Finding <br /> <br />FRANKLIN STREET PROJECT -11- Findings <br /> RD99-21 <br /> <br /> <br />
