receipt of written comments pertaining thereto, which period was subsequently <br />_ extended for 13 additional days; and <br /> <br /> WHEREAS, in accordance with the Agency's CEQA Procedures, the <br /> Planning Commission on March 16, 1999, held a duly noticed public hearing and <br /> received public oral and written comment on the Initial Study and the Tiered <br /> Franklin MND; <br /> <br /> WHEREAS, the Planning Commission recommended that the Agency <br /> consider the Initial Study and adopt the Tiered Franklin MND; <br /> <br /> WHEREAS, following the close of the period for receipt of written <br /> comments, on April 12, 1999, the Agency prepared responses to written and <br /> oral comments on the Mitigated Negative Declaration; and <br /> <br /> WHEREAS, the Agency has reviewed and considered the information <br /> contained in the revised Tiered Franklin MND for the Franklin Street Project; and <br /> <br /> WHEREAS, theTiered Franklin MND identifies several potential significant <br /> environmental effects of the Franklin Street Project which can be reduced or <br /> avoided to a clearly insignificant level; and <br /> <br /> WHEREAS, written findings accompanied by a brief explanation of the <br /> rationale for each finding have been prepared regarding the potential significant <br /> environmental effects of the Franklin Street Project Project; and <br /> <br /> WHEREAS, the discussion of impacts and mitigation measures in the <br /> Tiered Franklin MND is appropriate to the level of specificity required by the <br /> State CEQA Guidelines; and <br /> <br /> WHEREAS, Section 21081.6 of the Public Resources Code requires the <br /> Agency to adopt a reporting and monitoring program to ensure implementation of <br /> identified mitigation measures; and <br /> <br /> ~D-008 3 RD99-21 <br /> F/sh/sh/RC/Council/Reso <br /> DES:rg <br /> 04/20/99 <br /> <br /> <br />
