Residential uses at the ground floor street frontage shall <br /> incorporate planted areas and other elements that contribute to a <br /> pedestrian environment. <br /> b. Pedestrian-oriented design elements may also include street furniture, <br /> or other seating surfaces, on private property and design amenities <br /> scaled to the pedestrian, such as awnings, drinking fountains, <br /> fountains, paseos, arcades, colonnades, plazas, noncommercial <br /> community bulletin boards, public or private art and alternative paving <br /> materials in areas of pedestrian access. <br /> c. In order to encourage quality, creativity and compatibility, the <br /> Architectural Review Committee may approve an exception from the <br /> requirements of Subsection (a) of this Section if all of the following <br /> findings of fact can be made in an affirmative manner: <br /> 1. That strict application of the provisions of this Section would result <br /> in practical difficulties or unnecessary hardships inconsistent with <br /> the general purpose and intent of this Section or that there are <br /> exceptional circumstances or conditions applicable to the proposed <br /> development that do not apply generally to other developments <br /> covered by this Section; and <br /> 2. That the granting of an exception would not adversely affect <br /> surrounding properties or be detrimental to the district's pedestrian- <br /> oriented environment." <br /> <br /> Section 63. Section 26.2 is hereby amended to read as follows: <br /> <br /> "Section 26.2 Permitted Uses. The following retail uses are <br /> permitted: <br /> <br /> a. Antique shops; <br /> b Art supply stores and galleries; <br /> c. Auto parts sales; <br /> d. Bakeries; <br /> e. Financial services and title companies on second floor and <br /> above; <br /> f. Barber shops; <br /> g. Beauty parlors; <br /> h. Bicycle sales and repairs; <br /> i. Bookstores, including the sale of used books; <br /> j. Clothing stores, not including the sale of used clothing; <br /> k. Candy and ice cream stores; <br /> I. Computer and computer supply sales; <br /> m. Copy services; <br /> n.
