6. 1. F. - Page 51 <br />Any decision regarding the conduct of a pet shall be made only after notice to the Owner and the <br />opportunity to be heard before the Board, unless the Board determines it is an emergency. <br />(b) No pets shall be allowed in the Common Area except as may be permitted by the <br />rules of the Association. No dog whose barking unreasonably disturbs other Owners shall be permitted to <br />remain on the Development. Owners shall prevent their pet from soiling any portion of the Common <br />Area and shall promptly clean up any fouling by their pet. Declarant or any Owner may cause any <br />unauthorized pet found in the Common Area to be removed to a pound or animal shelter under the <br />jurisdiction of the City of Redwood City or County of San Mateo, by calling the appropriate authorities, <br />whereupon the Owner (upon payment of all expenses connected therewith) may repossess the pet. Each <br />person bringing or keeping a pet upon the Development shall be liable to the other Owners, their family <br />members, guests, invitees and tenants for any damage to Persons or property proximately caused by such <br />pet. Notwithstanding anything contained herein, each owner of a pet shall comply with each applicable <br />ordinance of the City of Redwood City and County of San Mateo. Animals may only be fed within the <br />confines of an Owner's Unit; feeding of animals within the Common Area or otherwise outside an <br />Owner's Unit is prohibited. <br />Section 7.5 Garbage and Refuse Disposal All rubbish, recycling, trash and garbage shall <br />be regularly removed from the Development and shall not be allowed to accumulate thereon. Trash, <br />garbage and other waste shall, at all times, be kept in designated sanitary containers. All equipment for <br />the storage or disposal of such waste material shall be kept in a clean, orderly and sanitary condition. To <br />the extent reasonable, all equipment, garbage and trash containers, woodpiles or storage piles shall be <br />kept in enclosed areas. <br />Section 7.6 Right to Lease With the exception of a Mortgagee in possession of a Unit <br />following a default in a First Mortgage, a foreclosure proceeding or any other deed or other arrangement <br />in lieu of foreclosure, no Owner shall be permitted to lease that Owner's Condominium for transient or <br />hotel purposes which shall be defined as (i) rental for any period less than thirty (30) days, or (ii) any <br />rental if the occupants of the Unit are provided customary hotel services such as room service for food <br />and beverage, maid services or the furnishing of laundry and linen subject to a fee. Subject to the <br />foregoing restriction, the Owner of the Condominium shall have the right to lease that Owner's <br />Condominium provided that the lease is for the entire Condominium (the taking in of a roommate by an <br />Owner shall not be a violation of this clause), is in writing and is expressly made subject to the <br />Condominium Documents and further provided that the breach by the tenant of such covenants, <br />conditions, restrictions, limitations, uses or rules shall also be a breach of the lease. Owners shall not <br />place rubbish, recycling, trash, garbage, similar items, or containers therefor, on the Common Area except <br />the night before and day of scheduled pick -ups, and shall promptly remove such items the day after the <br />scheduled pick -up (whether or not the pick -up actually occurs). <br />In the event an Owner does lease that Owner's Condominium as herein provided, that Owner <br />shall, within three (3) days of execution of the lease, provide the Board or the manager with the <br />following: <br />(a) Name of each permitted occupant; <br />(b) Current address and telephone of the Owner; <br />(c) A statement by the Owner that the tenant has received a copy of the Declaration <br />and any amendment thereto, the Articles, the Bylaws, the Association Rules, if any, and any rules and <br />regulations of the Architectural Control Committee and that such tenant has been advised of any <br />obligation that tenant may have thereunder; <br />41 <br />CCRS -One Marina. docx <br />
