6. 1. F. - Page 43 <br />seals, interior doors; cabinets, light bulbs; electrical panels and breakers, electrical wiring and other <br />fixtures of any nature whatsoever; "built -in" features; and decorative features, fireplaces, any furniture <br />and furnishings; plumbing pipes, sanitary sewer Lines, drains, flues, heating ducts, telephone lines or <br />equipment, television Lines or equipment or other utility equipment which serve only that Owner's Unit, <br />no matter where the equipment is located; provided, that any such equipment located in the Common <br />Area shall be maintained and repaired by the Association, or a licensed contractor approved by the <br />Association; provided, however, the maintenance, repair and/or replacement costs shall be paid by the <br />Owner of the Unit. In furtherance of the foregoing, each Owner shall bear the cost of any clearing of <br />blockage and damage repair to any toilet or lateral sanitary sewer line which serves only that Owner's <br />Unit. If the Owner fails to pay the cost or such maintenance or repairs, the Association may levy an <br />individual special assessment against the Owner's Condominium to reimburse the Association for costs <br />incurred. If the utility equipment or Lines serve two or more Units, the costs shall be borne by the <br />Association. If the maintenance, repair and /or replacement involves equipment or Lines, a portion of <br />which exclusively benefits one Unit and a portion of which benefits two or more Units, the Board shall <br />allocate the cost between the Unit Owner and the Association in a fair and equitable manner. <br />Each Owner shall keep any drain(s) located on that Owner's Exclusive Use Common Area patio <br />area clear, free of obstruction and in good working condition, and shall promptly report any problems <br />with functioning of the drain to the Association. <br />Each Owner shall maintain, repair and replace any smoke detectors located in that Owner's Unit. <br />The Association shall maintain any fire sprinkler heads and related systems located in any Unit, provided <br />that each Owner shall immediately notify the Association of any problems with any automatic sprinkler <br />heads located the Owner's Unit. <br />Subject to the Association Rules and Section 7.26 below, each Owner shall have the exclusive <br />right to paint, plaster, tile, wax, paper or otherwise refinish and decorate the inner surfaces of the walls, <br />ceilings, floors, windows and doors bounding that Owner's Unit in a manner which does not intrude on or <br />into the Common Area, which does not transmit unreasonable noise through the Common Area as <br />reasonably determined by the Board and which is not visually offensive to persons of ordinary <br />sensibilities viewing from the Common Area or public areas as reasonably determined by the Board. In <br />the event an Owner fails to maintain the interior of his Unit or fails to perform routine cleaning and <br />maintenance of any Exclusive Use Common Area to which he has an easement or assignment in a manner <br />which the Board deems necessary or appropriate to preserve the appearance and value of the <br />Development, the Board may notify the Owner of the work required and request that the Owner complete <br />such work within sixty (60) days from the date such notice was given to the Owner. In the event said <br />Owner fails to complete such work within said period, the Board may, after written notice to the Owner <br />and an opportunity for a hearing before the Board, cause such work to be done and the cost of such work <br />shall be a monetary penalty enforceable according to the provisions of the Bylaws and this Declaration <br />and shall be payable to the Association by such Owner. <br />Section 5.3 Maintenance of Exclusive Use Common Areas In addition to other provision <br />of the Declaration concerning maintenance of Exclusive Use Common Area by a Unit Owner or the <br />Association, the particular portions of the Exclusive Use Common Area described below shall be <br />maintained as described in this section. <br />(a) Patio Areas. Each Owner shall maintain the floor area of any patio area <br />appurtenant to that Owner's Unit, including, without limitation, built -up or raised decking or tile, and any <br />waterproofing treatment to the surface of such flooring. The Association shall maintain and repair the <br />structural components of the Common Area below the surface of the patio flooring associated with the <br />patio areas.
