6.2.C. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />September 19, 2011 <br />SUBJECT <br />Summarily vacate a public service easement and authorize the City Manager to execute <br />a quitclaim deed for two parcels in favor of the State of California in conjunction with the <br />Route 101 /Ralston Avenue Interchange Improvements Project <br />RECOMMENDATION <br />1. By resolution, approve the summary vacation of a public service easement over the <br />lands of the City of Redwood City, "Parcel 2" (as described in Exhibit A to proposed <br />resolution) pursuant to Article 8333 of the California Streets and Highways Code, in <br />conjunction with the Route 101 /Ralston Avenue Interchange Improvements Project. <br />(See Resolution, Attachment 1). <br />2. By motion, approve and authorize the City Manager to execute a quitclaim deed in <br />favor of the State of California, for two parcels, "Parcel 1" and "Parcel 2" (as described <br />in Exhibit A to quitclaim deed) located adjacent to the Route 101 northbound onramp <br />from Marine Parkway in conjunction with the Route 101 /Ralston Avenue Interchange <br />Improvements Project. (See Quitclaim Deed, Attachment 3). <br />BACKGROUND <br />On March 24, 2008, Council accepted the work of the Route 101 /Ralston Avenue <br />Interchange Improvements Project. Island Parkway was realigned as part of the project <br />and now intersects Marine Parkway at the northbound exit of Route 101 at Ralston. <br />The new configuration made a portion of the previously existing Island Parkway <br />adjacent to the two subject parcels no longer necessary as a public thoroughfare. <br />Please see attached Location Map (Attachment 2). <br />Similarly, as shown on the attached Location Map, Parcel 1, owned by the city, is now <br />within an area customarily owned and controlled by the state and is no longer needed <br />by the city. Parcel 2, owned by the city, was quitclaimed by Oracle Corporation and <br />granted to the city in 2004 as part of an agreement related to the reconfiguration project. <br />This parcel is also now within an area customarily owned and controlled by the state <br />and is no longer needed by the city. By quitclaiming the city's interest, these parcels <br />become a state right -of -way. <br />The city has a public service easement on Parcel 2, but the easement is no longer <br />useful due to the new configuration. The state requires that the quitclaimed parcels be <br />free from any local encumbrance; therefore, upon adoption of the proposed resolution, <br />the easement will be vacated and removed from the title before the quitclaim deed is <br />executed in favor of the state. <br />
