6.2.C. - Page 3 ATTACHMENT RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY VACATING A PUBLIC SERVICE EASEMENT ON "PARCEL 2" NEAR MARINE PARKWAY IN CONJUNCTION WITH THE ROUTE 101 /RALSTON AVENUE INTERCHANGE IMPROVEMENTS PROJECT WHEREAS, the City of Redwood City ( "City ") is the record owner of the property, as provided in Document No. 2004 - 101440 in the Official Records of San Mateo County on May 18, 2004; and WHEREAS, the City of Redwood City was the lead agency on the Route 101 /Ralston Avenue Interchange Improvements Project; and WHEREAS, the work of the Route 101 /Ralston Avenue Interchange Improvements Project involves various land transfers to the State of California for the purposes of highway interchange improvements; and WHEREAS, the Council accepted the work of the Route 101 /Ralston Avenue Interchange Improvements Project on March 24, 2008; and WHEREAS, a condition for authorization to construct the interchange improvements is that land underneath those improvements be granted to the State of California; and WHEREAS, a condition for authorization to construct the interchange improvements is that land granted to the state be free of easements and restrictions; and WHEREAS, to effectuate the above - mentioned grants to the State, the City must vacate a portion of a 5 foot wide public service easement, identified as Parcel 2 and depicted and described on Exhibit "A ", attached hereto ( "Vacation Area "); and WHEREAS, the City has determined that the Vacation Area identified above is excess; and WHEREAS, there are no public facilities located within the Vacation Area; and WHEREAS, Section 8333(c) of the Streets and Highways Code of the State of California allows a city to summarily vacate a public service easement if "the easement ATTY /RESO.2156 /SUMMARY VACATION 082211
