Wai�e reading and extend a temporary moratorium oc� th� establishmenf and <br /> aperation of inedical marijuar�a collecfi�es for a maximum period of 22 months and <br /> 15 days, by 415 majoriiy of the City Council (Attachment 1). <br /> 2. Direc� staff to prepare a permanent ordinance E�asec[ on Council's direction. <br /> BACKGROUND <br /> On December 14, 2009, the City Council, by 4I5 majority �ote, adopted a temporary <br /> moratarium on the establishment and operation of inedical marijuana collectives for 45 <br /> days. In adopting the interim ardinar�ce, the City Council recognized that a[lowing <br /> medicai marijuana-orienfed businesses �o operate �n Redwood City without apprapriate <br /> review of location, operational standards and an en#orcement sfrategy pases a �atentiai <br /> threat to public health and safety because of the adverse secondary impacts on <br /> residents, businesses, and neigh�ors to such businesses. <br /> Pursuant to Gavernment Code section 65858, the inifial 45-day moratorium wifl expire <br /> on .�anuary 28, 20'�4. The Cify Council may e�c#end the infe�im ardinance for an <br /> additional 22 months and 15 days. Go�ernment Cod� secfian 65858 requires that ter� <br /> days prior to the expiration of the interim ordinance or any extension thereof, the City <br /> Council must issue a written report describing the measure taken to alleviate tf�e <br /> candition that led ta �he adoption of the ordinance. This report serves as the repor� <br /> required under the Gov�rnment Code. <br /> Due to the �ariety of legal and practical issues associated with medical marijuana- <br /> oriented businesses, staff has only begun researching and drafting a compreh�nsive <br /> ardinance fo r�gulate medical marijuarta collectives. As such, staff is reqUesting that <br /> the City Council consider extending the moratorium for a maximum of 22 months and 15 <br /> days ar�d provide staff with specific direction with respec� to the forthcoming ordinance. <br /> Staff has researched the available regu[atory aptions for the City Cauncil to consider, as <br /> outfined below. <br /> As stated in the previous staff report (Attachment 2) medicaf marijuana-oriented <br /> businesses are not expressly regulated by tf�e Redwaod City Municipal Code or the <br /> Zoning Ordinance; howe�er, this type ofi land use is fypically cansidered to be relati�ely <br /> similar to a pharmacy, medica[ office or clinic. Under t�e City`s current Zoning <br /> 4rdinance, such a bUSiness could potentially operafie in a variety of zoning districts, <br /> includi�g near schoals or day care facilities, by obtaining a Use Permit.
