8A <br /> 7.A. - Page 23 Page 2 <br /> appropriate e�aluation of such a permit is cause for concern because the City has no <br /> adopted ordinances, po[icy or exper�ence with the use. <br /> Several nearby municipalities such as Colma, City af San Mateo, and San Matea <br /> Caun#y ha�e adopted ordinances which regulate medical marijuana collectives. Co�ies <br /> of these ordinances are attached for your reference (Attachments 3, 4 & 5). <br /> If inedical marijuana coliectives are fo be allowed, staff recommends extending the <br /> moratarium so #hat an ordinance reg�alating collectives within Redwooc[ City can be <br /> drafted. The following regula�ory options are listed below for your consideration and <br /> input: <br /> • Stafe f�ealthcare facility exception: Pro�ibit medical marijuana dispensaries or <br /> collectives but define "coEfective" or "dispensary" ir� such a manner as to prevent <br /> the establishmen� of "sforefront" dispensaries, but exemp� state-licens�d clinics <br /> and f�ealtF� care facilities so that these medica[ facilities would be able to serve <br /> the needs of individuals with serious and terminal illnesses (City of Colma's <br /> Ordinance; see Attachment 3). <br /> • Conditional Use Permit: AI1aw collecti�es and regulate them through �he Use <br /> Permit and/or licensing process (San Mateo County has employed tf�is appraach; <br /> see Attachment 4) . The verification process may in�al�e: <br /> o Praximity ta schools and parks (can be tracked fh�augh City's GIS) <br /> o Praximity ta r�sidentiaf areas (can be tracked through City's GIS) <br /> o Concentration (can he tracked through City's GIS) <br /> o Zoning disfirict compliance for this use <br /> o Architectural controfs for this use {e.g. logas, signage, security devices <br /> such as cameras, bars o� doorslwindows, etc) <br /> o Additiona[ regulatory tools that may include an iden�i�ication program for <br /> patrons, as well as, criminal �ackground checks for operators and <br /> em�loyees <br /> • Limit by Zaninq Districts: Allow medical marijuana collectives but regulate them <br /> by prohibiting them in residential districts, the downtown, and other zones where <br /> this use may be incompatible with adjaining uses, with some consideration gi�en <br /> ta distancing and concen�ration. Consider mandating distancing requirements <br /> from "sensitive" uses such as, schools, public parks, daycare facilities and �rom <br /> ofher callectives {fhe City of San Mateo has designated two zanes where s�c� <br /> faciiities may be a properly permitted use; see Attachment 5}. <br /> • Limi# by number of facilities: Allow medical marijuana calfectives to operate <br /> �nder broad standards or throug�t a Use Permit, but [imit the number of inedicaf <br /> marijuana co[iectives within the City �o a maximum af three {3} or same at�er <br /> number (the City of Berkeley adopted this approach). <br /> 2 <br />
