8A <br /> 7.A. - Page 25 Page 4 <br /> 1�!'�T'�4CHMENT �. <br /> ORDINANCE N4. <br /> AN iNTER�M ORDfNANCE OF THE CITY OF REDWOOD CITY <br /> EXTENDING A TEMPORARY MORATORIUM ON THE <br /> ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA <br /> C4LLECTIVES <br /> WHEREAS, the �a�ers of the State of California approved Proposition 215 <br /> {codified as Health and Safety Code section 11362.5 ef seq. and entitfed the <br /> "Compassionate Use Act of 1996") legalizing the use of marijuana for specific <br /> medicai purposes; and <br /> WHEREAS, in 2003, the Med�cal Marijuana Program Act (MMP) (Health <br /> and Safety Code section 11362.7 et seq.} was adopted, which clarified the scape <br /> of the Compassionate lJs� Act and allowed cities and other go�erning bodies to <br /> adopt and enforce rules c�nsistent with the MMP and the Act; and <br /> WHEREAS, the Ci�y's General Plan, Zoning Ordinance and Municipal <br /> Code do r�at specifica[ly address the regulation or location of ine�ical marijuana <br /> collectives (or "dispensaries") as a permitted or conditianally permitted use in any <br /> zoning district; and <br /> WHEREAS, the City has received inquires from pros�ecfi�e medical <br /> marijuana collective operators regarding the City's po[icy with respect to medical <br /> marijuana collectives; and <br /> WHEREAS, California cities that ha�e permitted the es�ab[ishment of <br /> medical marijuana collecti�es have o�served ad�erse impacts on public health, <br /> safety and welfare, inciuding an increase in crimes such as burgfaries, rabberies, <br /> or sale of illegal drugs at fhe col[ectives and in areas immediately surrounding the <br /> collecfi�es; and <br /> WHEREAS, there are several open state law questions regarding the <br /> regulation of inedical marijuana collectives; and <br /> WHEREAS, federal law classifies marij�aana as a Sched�le 1 drug with "no <br /> accepted medical va[ue in treatment,° and continues ta prohibit the cu�ti�ation, <br /> possession distribution of marijuana ; and <br /> Atty/Ordl0rd.328 � <br /> Oi141D <br />
