Rq <br /> 7.A. - Page 28 T <br /> SECTION 2. lnterim Moratorium fmposed <br /> A. �or a period of twenty-two (22) montns and fifteen (�5) days, <br /> commencing on the date of adaption of this interim ordinance, or <br /> until such time as this ordinance may expire, subject to any <br /> extension of this ordinance that the City Council may adopt and <br /> a��rove pursuant �a Sectian 65858 of the Go�ernment Code, no <br /> zoning ordinance interpretation or amendment, amendment to <br /> tf�� City's General Plan or Municipal Code, use permit, variance, <br /> building permit or any other entitlement for Use shal[ be <br /> approved or issued for the establishment or opera�ian of, and no <br /> person shall otherwise establish, a medical marijuana collective, <br /> as that term is defined below. <br /> B. For the purpose af fhis ordinance, "m�dical marijuana callective" <br /> inclUdes any site, facility, location, use, cooperative, dispensary, <br /> center, or business which distributes, sells, exchanges, <br /> processes, delivers, gives away, ar cultivates marijuana for <br /> medical purposes to quafified patients, health care providers, <br /> patients' primary caregivers, or physicians pursuant ta <br /> Proposition 2�5, Health and Safefy Code section 11362.5 et <br /> seq. as amen�ed, or ar�y state regulations adapted in <br /> f��therance thereof. Marijuana shall also mean cannabis and al[ <br /> parts of that plant. <br /> SECTION 3. Compliance with California Environmental Quality Act <br /> The City Council finds that this ordinance �alls �nder the California <br /> Environmental Quality Ac# (CEQA} exemption foun� at Titie 1� California <br /> Code of R�gulations section 95061 (b} (3) because the femporary <br /> prohibitian of inedical marij�aana col[ecti�es does not have the potential to <br /> significantly impact the environmen�. <br /> SECTION 4. Effective Dat� <br /> This ordinance is an interim ardinance and shall take effect and be <br /> er�forced immediately upon adoption. In accordance wifh California <br /> Government Code section 65858, this ordinance shal] be in full force and <br /> effect for a period of twenty-#wo (22) months and fifteen (15) days from <br /> and after the date of �ts adoption on January 25, 2010 and shall be of no <br /> f�rther force and effect unless this period is extended by the City Council <br /> in accordance wifh Califarnia Government Code sec�ion 65858. <br /> Atty/OrdlOrd.328 4 <br /> 07141Q <br />
