In ci#ies ti�at have permitted m�dical marijuana collectives, <br /> issues and concerns have arisen reEated to the establishment of <br /> medical marijuana collectives in close proximity to residential <br /> proper�ies, schools, and day care facilities. Furthermore, those <br /> cities have reported increases in loitering, illegal drug activity, <br /> burglaries, robberies, and other crimina] activity within and <br /> araund the collecti�es, as well as increased pedestrian and <br /> �ehicular trafFic, noise and parking violations. Medical <br /> marijuana collectives andlor dispe�saries have also resulted in <br /> increased �emands for police response, as well as mair�tenance <br /> of public streets and sidewalks. <br /> F. The use, possession, cultivation, or distribution of marijuana for <br /> any purpose remains illegal �nder federal law. <br /> G. There are several open questions of state law regarding the <br /> regulation of inedical marijuar�a col[ecti�es, including how ta <br /> interpret the State Atforney General's A�gust 2008 "Guidelines <br /> for the Security and Non-Diversion of Marijuana Grown for <br /> medicaf Use." <br /> H. To protect resi�ents and businesses from potential harmfui <br /> communi�y impacts resuf�in� from medical marijuana collectives, <br /> City staff needs time to study the legality, potential adverse <br /> community impacts, and mechanisms for regulating medical <br /> marijuana collecti�es. <br /> I. If inedicaf marijuana callectives are allowed to proceed without <br /> appropriate re�iew of location, operation criteria and standards, <br /> fihe col[ectives could conf[ict with reqUirements of the General <br /> Plan, the City's Zoning Ordinance, and forthcoming state law <br /> and City regulations and result in irrev�rsible incompatibifity af <br /> land uses an� adverse impacts on residents, businesses, and <br /> neighborhoods that present a clear and immediate danger to the <br /> public health, safety, and welfare. <br /> J.
