MARIJUANA <br /> COLLECTIVES <br /> WHEREAS, #he �oters of the State of California approved Proposition 2'l� <br /> (codifiied as Hea�t� and Safety Code sec�ion 11362.5 ef seq, and entifled the <br /> "CompassioRafe Use Act of 1996") fega�izing the use of marijuana for specific <br /> medica( ��rposes; and <br /> WHEREAS, in 2003, #he Medical MarijuaRa Program Act (MMP) (Health <br /> and Safie#y Code section 11362.7 ef seq.) was adopted, whic� c�arified the sco�e <br /> o�the Campassionate Use Act and allowed cities and other gaverning bodies �o <br /> adopt and enfiorce rules consistent with the MMP and the Act; and <br /> WHEREAS, �he Ciiy's Genera� Plan, Zoning 4rdinance and Municipal <br /> Cade da nat specifiica[ly ac�dress the regulation or location of inedical mari�uana <br /> �ollecfi�es (or"dispensaries") as a petmitteci or canditionally permitted use in any <br /> zoning distric#; and <br /> WHEREAS, the City has recei�ed inquires firom prospectiue medical <br /> marijuar�a collecfi�e operators regarding the City's policy witF� respec# ta medical <br /> marijuana collecfives; and <br /> WH�REAS, Califarnia cities that ha�e permitted the establishment of <br /> medica� marijuana collecti�es ha�e observed ad�erse impacts on pubEic hea�th, <br /> safety and welfare, includi�g an increase in crimes such as burglaries, robberies, <br /> ar sale of iliegal drugs at#he collectives and in areas immediately surrounding th� <br /> callectives; and <br /> WHEREAS, there are se�eral open state law questiot�s regardin� the <br /> regulafion of inedicai marijuana collecti�es; and <br /> WHEREAS, �ederal law classifies marij�ana as a Sched�le 1 drug with "no <br /> acce�ted medical value in treatment," ar�d continues fo prohibit t�e cultivation, <br /> possessian distribution of mari�uar�a ; and <br /> Atty/brd/Ord.327 '1 <br /> '�20309 <br />
