Primary Caregivers, <br /> Qualified Patients, and Persans with Identificarion Cards cultivating medical <br /> marijuana at a collective sha[f regist�r with the Police Chief, providing the name <br /> of a responsible party, a telephone number, the place of operation of fihe <br /> col[ec�ive, and such other information as may be reasonabfy required by the <br /> Palice Chief. (Ord. 2009-6 § 1, 2009}. <br /> ARTICL� 2. LTCENSING REQUIREMENT AND PROCEDURE <br /> 7.46.�40 R�QUYREMENT FOR CITY LICENSE. <br /> {a} Qnly Qualified Patients, Persons with IdentiFication Cards and Primary <br /> Caregivers may cultivate and store medical marijuana colEectively. Medical <br /> marijuana collectives are required to obtain a license to operate within the City of <br /> San Mateo. <br /> (b) An application far a li�ense under �his Chapter shall include; <br /> (1} a warning that persons callec�ively cultivating medical marijuana at <br /> facilities licensed under this Chapter may be subject to prosecution under federaE <br /> laws. <br /> (2) the applicant's waiver and release of the City frorn any and all 3egal <br /> liability refated to or arising from the application for a license, the issuance af the <br /> licen5e, or the enForcement of the conditions af the license, and/or the operation <br /> of any Facility at which where medical marijuana is co[lectively cu[tivaCed. {Ord. <br /> 2009-6 § 1, 2009). <br /> 7.4fi,Q5Q L,xCENSE PROCEDURE. <br /> (a) Every persan who propases to participate in the collectiv� or cooperative <br /> cuftiva�ion and/or storage of inedical marijuana in the City of San Mateo shall file <br /> an application with the �icense Committee upon a form pro�ided by the City o� <br /> San Mateo Police Department and shall pay a filing fee, as established by <br /> resofution adopted by the City Council. <br /> (b) Applications shall include the following information: <br /> (1) Each individual member of the cooperative or collective shall state <br /> ti�eir [ega[ name (inc[uding any a[iases}, address, and tele�hone number. <br /> (Z) Each individual member of the cooperative or collective shall provide <br /> evidence that they are a qualified patient, person with an ider�ti�ication card, or a <br /> primary caregiver. <br /> (3} I� the applicant is a cooperative, it shal] provide a copy oF its articles <br /> of incarporation and shall provide the information required by subsec�ions (b)(1} <br /> and (b)(Z) for each of its members. <br /> (�) The proposed address where �he applicants intend to cultivate and/or <br /> store medica] marijuana, pfus the names and addresses of the owners of the <br /> propose� sife. <br /> (S) The address to which notice of action on the application is to be <br /> mailed. <br /> {c} Upon receipt of a completed appfication and payment �he fee, the License <br /> Committee shall promp�[y investigate the infarmation contained in the application <br /> to determine whether the applicant shall be issued a license, <br /> (d) The License Committee shal! apprave a license application, unless: <br /> http://www.ci.sanmateo.ca.uslindex.aspx?NID=1757&�REVIEW=YES 1/14/2010 <br />
