7.A. - Page 61 <br /> ATTACHN�NT 3 <br /> Notification <br /> ❑ Daily News, September 10, 2011 <br /> ❑ Notices sent to parties who expressed interest in this topic, specifically those who <br /> made comments at the City County Interim Ordinance hearings <br /> Recommendation and Next Steps <br /> ❑ Recommend that City Council consider the zoning amendment to establish a ban <br /> on medical marijuana distribution facilities <br /> ❑ Consider using a "sunset clause" to require revisiting the proposed ordinance in a <br /> specified time frame and/or sooner if identified as a priority. <br /> ❑ City council will consider and take action on the proposed zoning amendment at <br /> a future meeting <br /> Commissioner Radcliffe asked if childcare centers are included on the maps. <br /> Ms Ekas replied that it didn't seem to make much difference in the residential, but there <br /> are childcare centers mixed in with employment areas. <br /> Commissioner Radcliffe noted the center in Redwood Shores. <br /> Ms. Ekas pointed out the centers in the Redwood Shores area and also noted the <br /> potential for a center to be located in a few other locations. She stated that the office <br /> park environment is what was intended for focus. <br /> Chair Borgens asked what if, in a few years after everything has been established, <br /> someone asks to put in a childcare center or a school. She asked that they can't <br /> because of what is around. <br /> Mrs. Stevenson talked about state laws being formed regarding the location of <br /> dispensaries within a certain radius of other uses. She noted that there was not a state <br /> statute. <br /> Chair Borgens noted that there may not be a state statute but the city could implement a <br /> statute. She asked that once a zoning area is established, the criteria of its location <br /> could be written. <br /> Ms. Skousen stated there are similar prohibitions on establishments that sell alcohol in <br /> terms of how close they can be to schools. She noted that if the alcohol establishment is <br /> already there and a daycare center or school moves next to them, case law says the <br /> alcohol establishment does not have to move. <br /> Commissioner Bondonno asked if the sunset clause were included the ordinance and <br /> zoning could be reevaluated at any time before the sunset clause came due. <br /> Ms. Ekas noted that the zoning code could be amended at any time, initiated by city <br /> council, staff, or planning commission. The sunset clause could be amended. <br /> Commissioner Bondonno asked if there were not a sunset clause that the same <br /> procedures could be in place and at any point before or after, regardless of date and <br /> time, it could all be amended. <br /> Page 9 of 16 <br />
