6.2.B. - Page 4 RESOLUTION NO. RESOLUTION OF NOTICE OF INTENT TO VACATE PORTIONS OF WALNUT STREET IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of Division 9 of the California Streets and Highways Code, the City Council of the City of Redwood City ( "City Council'), hereby declares its intention to vacate an excess portion of City right -of -way within Walnut Street located as shown on Parcel Map No. 2007 -02 in Book 77 of Parcel Maps, at Pages 85 and 86, in the office of the Recorder for the County of San Mateo; is attached hereto as Exhibit 1 and Exhibit 2; and WHEREAS, because there are in -place utilities that are in use, vacation of Walnut Street is subject to a reservation and exception from vacation of an easement and right to construct, maintain, operate, replace, remove, or renew public utility facilities, unless the City Council determines the public convenience and necessity require otherwise; and WHEREAS, attached to Exhibit 3 (Public Hearing Notice.) is a map or plan and legal description that shows the area intended to be vacated; and WHEREAS, pursuant to said provisions of the California Streets and Highways Code, notice of intention to vacate the herein described portion of the Walnut Street right of way shall be published and posted in substantially the form attached hereto as Exhibit 3; and WHEREAS, a noticed public hearing on the question of vacating portions of Walnut Street, as described below, shall be held and evidence thereon received by the City Council on November 14, 2011; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. 2. The City Council declares its intention to vacate portions of Walnut Street, the hereinafter described portion of Walnut Street found on Parcel Map No. 2007 -02, on the basis that it is unnecessary for present or prospective public purposes; ATTY /RESO.2167 /NOTICE OF INTENT TO VACATE WALNUT STREET 100711 1
